COMMUNITY CENTER LEASE AGREEMENT THIS AGREEMENT is made this ___1fub day of Oc:tnhc>r , 2000, between the City of Moscow, a municipal corporation of Idaho (Lessor), and the Friendly Neighbors Senior Citizens Club (Lessee), to-wit: WHEREAS, Lessor values its continuing relationship with Lessee; and WHEREAS, Lessor wishes to assure Lessee that, for a period of not more than five years from the date of the execution of this Agreement, Lessor does not desire to increase the per month fee paid by Lessee for use of Lessee's facilities; and WHEREAS, it is the plan of Lessor to reserve and prepare a space for the use of Lessee in the 1912 Center before the term of this current Agreement expires; and WHEREAS, in the meantime, Lessor and Lessee wish to continue the Lease terms in a manner which will not disrupt Lessee's current use of Lessor's facilities. NOW, WHEREFORE, PREMISES CONSIDERED, Lessor hereby agrees to lease to Lessee certain areas within the Moscow Community Center located at Third and Washington Street in Moscow, Idaho, subject to the following covenants, reservations, and conditions: 1. TERM. This lease shall be effective for a period of twelve (12) months commencing on October 1, 2000, and terminating on September 30, 2001. 2. LEASED PREMISES. Lessee shall have the full use of the following premises two days per week, Tuesdays, and Thursdays, from 6:00 a.m. until 3:00 p.m. for the period of this Agreement. A. Main Meeting Room on the first floor; B. Kitchen Area on the first floor. Lessee shall have the full use of the following premises for the period of this Agreement: A. Designated Office Space located on the first floor. 3. RENT. The Lessee hereby agrees to pay rent to the City as follows: A. LEASE AGREEMENT Two Hundred Dollars ( $200.00) per month for use of the kitchen area, meeting room, and office space. Page 1 of 3 2000-65 ---PAGE BREAK--- B. Rent shall be due and payable on or before the 1Oth day of each month. 4. TERMINATION. The parties reserve the right to terminate this Agreement without penalty upon sixty- (60) days written notice to the other party. 5. SUSPENSION. This Agreement shall be suspended if said premises are damaged or destroyed. Said suspension will continue until such time as the premises are restored, but in no case shall such suspension extend beyond the termination date of this Agreement. 6. INSURANCE. Lessee agrees to provide general liability insurance in the amount of Five Hundred Thousand Dollars ( $500,000.00) for activities related to its use of the premises, and further shall include the City of Moscow as a named insured under said policy of insurance. Lessee further agrees to hold the City of Moscow, its agents, servants, employees, officers and contractors harmless from any and all claims, causes of action or damages which may arise from Lessee's use of said premises. 7. ADDRESSES. All notices or other written communications required by this agreement shall be deemed served by certified mailing of notice through the United States mail to the other party at the following address: City of Moscow P.O. Box 9203 Moscow, Idaho 83843 Friendly Neighbors Senior Citizens Club c/o Moscow Community Center 206 East Third Street Moscow, Idaho 83843 8. ANTI-DISCRIMINATION. Lessee agrees that it shall not discriminate as to the use of the premises, or in employment, on the basis of age, sex, race, religious affiliation, or handicap. Lessee agrees to conduct its operations in compliance with all-applicable laws, ordinances, and regulations of all applicable government agencies, boards, or departments. 9. ASSIGNMENT. Neither this Agreement nor the premises may be assigned by the Lessee. 10. INSPECTION. Lessor, by its duly authorized representatives or officials, shall have access at all times to examine and/or inspect the premises. LEASE AGREEMENT Page 2 of 3 ---PAGE BREAK--- 11 . DEFAULT. If Lessee shall default in the performance of any provision of this Agreement, and such default is not remedied within ten ( 1 0) days after receipt of written notice thereof by the Lessor to the Lessee, or if the Lessee shall abandon the premises, the Lessor may terminate this Agreement upon written notice to the Lessee and further may exercise any remedy allowed by law to enter upon and take possession of said premises and shall hold Lessee responsible for damages by reason of such default. 12. CONDITION OF PREMISES/WASTE. Lessee accepts the premises in the present condition, and Lessor shall be under no obligation to repair, maintain, or improve the premises for the benefit of the Lessee during the term of this Agreement. Upon termination of this Agreement, Lessee shall restore the premises to the condition they were in at the beginning of this Agreement, and shall repair any damages to the premises stemming from Lessee's use of the premises. Lessee further agrees that Lessee shall not alter the premises, either temporarily or permanently.
