ORDINANCE NOą 1232 AN ORD INANCE AUTHORIZING THE CONVEYANCE OF REAL PROPERTY DESCRIBED IN SECT ION 2 OF THIS ORDINANCE BY THE C ITY OF MOSCOW, IDAHO, TO MOSCOW CEMETERY MAINTENANCE D ISTRICT PURSUANT TO SECTION 50-1405, IDAHO CODE; PROV IDING FOR THE PUBLICATION OF THI S ORDINANCE; AND PROV IDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE C ITY OF MOSCOW, IDAHO, AS FOLLOilS: Section 1: AUTHORITY TO CONVEY. That the conveyance of the real property described in Paragraph 2 of this ordinance by the City of Moscow, Idaho, to Moscow Cemetery Maintenance District, a cemetery maintenance district, in Latah County, State of Idaho, organized and existing under and by virtue of the laws and statutes of the State of Idaho, for public use, without monetary consideration, be, and such conveyance hereby is, authorized. Section lA. F IND ING. That the conveyance authorized in and by this ordinance is in the best interest of the City of Moscow, Idaho. Section 2. DESCRIPTION OF REAL PROPERTY. That the real property men- tioned in Section 1 of this ordinance is situated in Latah County, State of Idaho, and is more particularly described as follows, to-wit: - p- . Commencing at tl1e northwest corner of the southwest Quarter of Section sixteen (16), Township thirty-nine (39) North, Range five West Boise Meridian; thence proceeding southerly along the west line of Section sixteen (16) a distance of ninety-nine and fifty-nine hundredths (99.591) feet; thence North eighty-nine degrees (89°) nineteen minutes (191) twenty seconds (20") East, forty (40.001) feet to the northwest corner of the Mercer Subdivision as shown by the recorded plat thereof; thence South along the west boundary of said Subdivision, twenty (20.001) feet to the northwest corner of Lot forty (40) of the aforesaid Section sixteen (16); thence South along the west boundary of the aforesaid Subdivision, four hundred ninety-two and futy hundredths (492.501) feet to the southwest corner thereof, said point being the true point of commencement; thence southerly along the west boundaries of Lots forty (40) and forty-one (41) of the aforesaid Section sixteen (16) to a point on the north right-of way boundary of the State of Idaho Highway Number Eight as shown on the official plat 0f Moscow-Troy (N.R. S. 190-A, 1935) Highway Survey on file in the office of the Department of Public Works of the State of Idaho, whi"ch point is also on a tangent curve of one thousand three hundred ninety-nine and fifty hundredths (1,399.501) foot radius concave northerly at Highway Station sixty (60) plus fifty-four and seventy-six hundredths (54.76), more or less; thence easterly through a central angle of twenty-two degrees (22°) four minutes (04•) thirty-one seconds (3111) a distance of five hundred thirty-nine and twenty-one hundredths (539.211) feet to Highway Station sixty-six (66) plus thirty-three and sixty hundredths (33.60); thence North eighty-six degrees (86°) forty-one minutes (411) zero seconds (0011) East along said Highway right-of-way boundary, one thousand four hundred one and twenty hundredths (1,401.20') feet to ---PAGE BREAK--- a point on the east boundary of Lot forty-three (43) of the aforesaid Section sixteen (16), which point is at Highway Station ninety-six (96) plus zero two (02); thence northerly along said east boundary of Lot forty-three (43) a distance of seven (7.001) feet; thence North eighty-six degrees (86°) forty-one minutes (411) zero seconds (00") East along the aforesaid Highway right-of-way boundary, three hundred twenty-eight and seventy hundredths (328.701) feet to a point at High way Station ninety-nine (99) plus thirty and seventy hundredths (30.70), wh_ich point is the beginning of a tangent curve of said Highway right of-way of three thousand seven hundred eighty-seven foot radius (3,787.00•) concave northerly; thence easterly through a central angle of zero degrees (00°) forty-six minutes (461) twenty-five seconds (25") a distance of fifty-one and thirteen hundredths (51.131) feet to a point at Highway Station ninety-nine (99) plus eighty-two and twenty-seven hundredths (82.27), which point is the southwesterly corner of the L. Ashbaugh land as recorded in the Latah County Book of Deeds 161, pages 13 and 16; thence northerly along the west boundary of said L. Ashbaugh land, two hundred eighty-five and fifty hundredths (285.501) feet to the northwesterly corner thereof; thence northerly on a line parallel to the East boundary of Lot forty-four (44) of the aforesaid Section sixteen (16), along the west boundary of the John Mix land as recorded in Book of Deeds 154, page 532 and Book 155, page 535, to a point on the east-west centerline of Lot thirty-seven (37), which point is three hundred ten (310.001) feet north of the south boundary of said Lot thirty-seven (37); thence westerly along said centerline, which centerline is the south boundary of the Jabbora land as recorded in Book of Deeds 129, page 421, a distance of three hundred eighty (380.001) feet, to a point on the west boundary of said Lot thirty-seven (374 which point is the soythwesterly corner of said Jabbora land; thence South zero degrees (00°) thirteen minutes (131) twenty seconds (20") East to a point which is three hundred fourteen and thirteen hundredths (314.131) feet southerly of the north boundaries of said Lot thirty-seven (37) and Lot thirty-eight (38) of the aforesaid Section sixteen (16); thence South eighty-seven degrees (870) twenty-eight minutes (281) twenty seconds (2011) West, one thousand four hundred forty and fifty-two hundredths (1,440.521) feet; thence South seventy-seven degrees (770) twenty-three minutes (231) zero seconds (00") West, one hundred twenty-two and eighteen hundredths (122.181) feet to the southeasterly corner of the afore said Mercer Subdivision; thence continuing South seventy-seven degrees (77°) twenty-three minutes (231) zero seconds (00") West along the south boundary of said Mercer Subdivision, four hundred thirteen and thirty-two hundredths (413.321) feet to the true point of com mencement of the land herein described. Section 3. PROCEDURE. That the Mayor of the City of Moscow, Idaho, be, and he hereby is authorized, empowered and directed, in the name of the City of Moscow, Idaho, to execute, acknowledge and deliver to said Moscow Cemetery Maintenance District a deed conveying to said Moscow Cemetery Maintenance District all of the right, title and interest of the City of Moscow, Idaho, in and to the real property described in section 2 of this ordinance, for public use without monetary consideration, under the provisions of Section 50-1405 of the Idaho Code. . . ) ' - . - . . . Tnat this ordinance shall be published in one issue of the official newspaper of the City of Moscow, Idaho, within thirty (30) days after the passage thereof. Section 5. EFFECTIVE DATE. That this ordinance shall be in full force and effect from and after the date of its passage, approval and publication thereof as aforesaid.
