RELEASE AND SATISFACTION OF OBLIGATIONS OF LICENSE THIS RELEASE, executed by Glenn H. Petry and Melodic K. Petry, husband and wife (hereinafter "Owners") to the City of Moscow, a municipal corporation of the State ofldaho (hereinafter "City"): WITNESSETH: WHEREAS, Owners are the owners of real property situated in the City of Moscow, County of Latah, State of!daho, more specifically described as follows: Lots 1-6, Block 3, of Lieuallen's 4th Addition to the City of Moscow. WHEREAS, the Spokane, Coeur d'Alene and Palouse Railway was the record owner of the real property described above on March 6, 1936; and WHEREAS, on March 6, 1936, the Spokane, Coeur d'Alene and Palouse Railway granted a license to the City of Moscow for the construction, maintenance and repair of a ditch, containing Hogg Creek, on its property, subject to certain conditions; and WHEREAS. such license agreement, by its written terms, inures to the benefit of and is binding upon the executors, administrators, successors and assigns of the City and the Spokane, Coeur d'Alene and Palouse Railway; and WHEREAS, Owners purchased said property subject to the "Release and Satisfaction of the Obligations of License Agreement" executed between J&D and the City of Moscow. NOW, THEREFORE, it is hereby agreed by Owners, on consideration of the mutual covenants and promises recited above: I. That Ov.mers release the City from the obligations of the license agreement made between the City of Moscow and the Spokane, Coeur d'Alene and Palouse Railway, the same having been fully satisfied, and the obligations of the City discharged.
