ORDINANCE NO. 1215 AN ORDINANCE VACATING AND ABANDONING PREMISES AND RIGHTS DESCRIBED IN SECTIONS 1 AND 2 OF THIS ORDINANCE; PROVIDING THAT SAID VACATED AND ABANDONED PREMISES SHALL REVERT TO JOHN T. ZIMMER AND EVELYN J. ZIMMER; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF MOSCOW, IDAHO: Section 1: VACATION AND ABANDONMENT. That the premises and rights described in Section 2 of this ordinance be, and the same hereby are vacated and abandoned; PROVIDED HOWEVER, that the rights of way, easements and franchises of any lot owner or public utility shall not be impaired by the said vacation and abandonment. Section 2. DESCRIPTION OF PREMISES AND RIGHTS. That the premises and rights vacated and abandoned by this ordinance are the premises and rights conveyed by John T. Zimmer and Evelyn J. Zimmer, husband and wife, to the City of Moscow, Idaho by a Deed of Dedication, dated July 31, 1967, recorded in Book 161 of Deeds, at Page 307, records of Latah County, State of Idaho, which said premises are situated in Latah County, State of Idaho, and are more particularly described as follows, to-wit: Beginning at the Southwest corner of Lot 5, of Block Two of Lieuallen's Fourth Addition to the City of Moscow and shown on the recorded plat thereof; thence West on a bearing parallel to and coinciding with the westerly extension of the South line of said Lot Five a distance of Sixteen (16) feet to a point on the West line of the alley in Block Two of said addition to the true point of beginning; thence South along said West line of said alley a distance of Sixty-Six and Seventy-One Hundredths (66.71) feet, thence N 34°00' W a distance of Eighty and Forty­ seven Hundredths (80. 47) feet; thence East a distance of Forty-five (45.00) feet to the true point of beginning. Section 3. REVERSION. That the premises and rights vacated and abandoned by this ordinance shall revert to John T. Zimmer and Evelyn J. Zimmer, husband and wife, and the City of Moscow, Idaho shall, and does hereby, release, remise and forever quit claim ---PAGE BREAK--- said premises and rights to the said John T. Zimmer and Evelyn J. Zimmer; PROVIDED HOWEVER, that the rights of way, easements and franchises of any lot owner or public utility shall not be im- paired by the said vacation and abandonment. Section 4. PUBLICATION. That this ordinance shall be pub- lished in one issue of the official newspaper of the City of Moscow, Idaho. Section 5. EFFECTIVE DATE. That this ordinance shall be in full force and effect from and after the date of its passage, approval and the first publication thereof.
