ACCEPTA.1'fCE OF COl'iTR.A.CT ;I..,V!ENDNfEN1S EXHIBIT A: SCHEDULE OF REIMBURSEMENT AMENDED EXHIBIT B OTHER TERMS Latah County, Idaho and the City of Moscow hereby accept the attached Exhibit A: Schedule of Reimbursement and Amended Exhibit K Other Terms as contract amendments to solid waste disposal and program services performed pursuant to the Solid Waste Disposal Agreement dated December 20, 1994 (Agreement). Both parties accept these Exhibits as fully applicable amendments to the Agreement. SCHEDULE OF REllv1BURSElv.tENT JCKEDULE OF /I ---PAGE BREAK--- EXHIBIT A SCHEDULE OF REIJ\1BURSEMENT Latah County agrees to pay the City the amounts shown herein for Solid Waste Disposal and Program Services Pertormed pursuant to this Agreement, as may hereafter be adjusted in accordance with this Agreement. I . Base Rate, Transport Waste Disposal: Latah County shall pay the City the amount of $55.00 per ton of Transport Waste delivered to the Designated Waste Processing Facility by Latah County's Collection Franchisee or other person or entity authorized by Latah County. 2. Base Rate, Demolition/Inert Waste Disposal: Latah County shall pay the City the amount of $20.00 per ton of Inert/Demolition Waste delivered to the Designated Waste Processing Facility by Latah County's Collection Franchisee or other person or entity authorized by Latah County. 3. Base Rate, Compostab!e Waste: Latah County sliall pay the City the amount of S-0- per ton of Compostable Waste delivered to the Designated Waste Processing Facility by Latah County's Collection Franchisee or other person or entity authorized by Latah County. 4. Base Rate, Recyclable Materials: Latah County shall pay the City the amount of per ton of Recyclable Materials delivered to the City of Moscow Recycling Center by Latah County's Collection Franchisee or other person or entity authorized by Latah County. 5 . Program Cost Rates: Latah County shall pay the City the amount of $0.50 per month per billed Latah County Collection Unit, for a minimum of 3389.5 units. This rate shall pay for access by individual Latah County residents to the City of Moscow Recycling Center, Household Hazardous Waste Collection Program, Solid Waste Education and individual access for direct delivery to the Designated Waste Processing Facility, provided however, that individual access to the Designated Waste Processing Facility shall be limited to !00 pounds ofTransport Waste and/or !,000 pounds of Demolition/Inert Wasre or Compostable Waste per day, per Latah County resident, and that any amount of Acceptable Waste in excess of the above amounts shall be billed directly to the resident, at the rates of $0.0275 per pound of Transpon: Waste and $0.0! per pound of Demolition/Inert Waste or Compostable Waste, or as hereafter adjusted in accordance with this Agreement. 6. White Goods: Latah County shall pay the City the amount of per non-CFC bearing white good and per CFC bearing white good delivered to said facility by Latah County's Collection Franchisee, other person or entity authorized by Latah County, or Latah County resident. This appears to give maximum flexibility to both the County and the City in making decisions regarding the solid waste system. Please consider these changes and execute the attached Acknowledgment and return it to me at your earliest convenience. I will then present it to the City Council for their review and we can all proceed with the business of solid waste management. Thank you for your time and consideration in this matter. Latah County and the City agree that Section 22 (Liquidated Damages) of the Solid Waste Disposal Agreement signed on December 20, 1994 (Agreement) shall no longer be effective and shall be stricken from the Agreement. 2. The City agrees that it will increase its efforts to include rural Latah County in all solid waste educational programs and will engage in meaningful consultation with Latah County regarding the content, frequency, and methods used in those programs. 3. Latah County and the City agree that Section 3 (Designation of ultimate Disposal Sites) shall be amended to provide that the City shall seek the input of Latah County in designating a location or locations for ultimate disposal of solid waste and shall in good faith consider such input; provided however, that after considering such input, the ultimate decision in making a selection shall remain with the City of Moscow. 4. The expiration date of the current Agreement will remain the same. Renewals of that Agreement may be negotiated between the City and County.
