RESOLUTION NO. 2009-01 A RESOLUTION OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF IDAHO, ADOPTING A SCHEDULE OF SECURITY DEPOSIT RATES TO BE ASSESSED FOR STREET EXCAVATION PERMITS AS SPECIFIED BY CITY CODE; AND PROVIDING FOR THE EFFECTIVE DATE OF SUCH RATES. WHEREAS, City of Moscow Code, Title 5, Chapter 6, Excavations, requires a pennit to perform excavation or filling of an excavation in any public place and such pennit application shall be accompanied with a cash deposit not to exceed Two Thousand Dollars ($2,000) in accordance with the adopted rate schedule of the City; and WHEREAS, City Council deems it advisable to adopt security deposit rates for excavations within the City; and WHEREAS, Council has determined that the rates included in this Resolution are appropriate and are reasonably related to the purpose for which such rates are required; NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Moscow as follows: 1. That the secmity deposit rates set forth in Exhibit attached hereto and made a part hereof, be in force and effect in all matters relating to such rates from and after the 151 day of January 2009. 2. That any resolution or provision thereof which is inconsistent with this Resolution is hereby repealed.
