ORDINANCE NO. 2004-36 Co.K.fchi7'1 'f(lf2t. 3 AN ORDINANCE OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, PROVIDING THAT LAND ADDRESSED AS 1025 N MOUNTAIN VIEW ROAD AND DESCRIBED IN SECTION 1 OF THIS ORDINANCE BE ANNEXED TO THE CITY OF MOSCOW; PROVIDING THAT THE PROVISIONS OF THIS ORDINANCE BE DEEMED SEVERABLE; PROVIDING FOR THIS ORDINANCE TO BE IN FULL FORCE AND EFFECT FROM AND AFTER PASSAGE, APPROVAL AND PUBLICATION ACCORDING TO LAW. WHEREAS, the land described in Section 1 of this Ordinance is adjacent to City limits on its west side and has been requested to be annexed by the owner or representative thereof; and WHEREAS, Idaho Code Section 50-222 authorizes City annexation of tracts of land adjacent to the City; and WHEREAS, the Moscow Mayor and City Council held a public hearing regarding this matter on November 15, 2004; and found that the annexation of the land described in Section I of this Ordinance is consistent with the City's annexation policy as set forth in Resolution 2001-15. NOW THEREFORE, be it ordained by the Mayor and Council of the City of Moscow as follows: SECTION I: LEGAL DESCRIPTION: This Ordinance shall apply to the following described land in Moscow, Latah County, Idaho, to-wit: A Parcel of land located in the SWV4 of the SWV4 of Section 4, Township 39 North, Range 5 West, Boise Meridian, Latah County, Idaho more particularly described as follows: Commencing at the southwest comer of said Section 4 (monumented by a 2" Aluminum Cap) and running thence N 0°25'22"E 30.00 feet along the west line of said Section 4 to the TRUE POINT OF BEGINNING for this description, said point being on the north right-of-way line of Mountain View Road; thence N 0°25'22"E 1292.71 feet along the west line of said Section 4 to a point that is the northwest comer of the SW V4 of the SWV4 of said Section 4; thence S 88°51 '12"E 331.48 feet along the north line of the SWV4 of the SW!/4 of said Section 4; thence S 0°27'22"W 1292.17 feet to a point on the north right-of-way line of Mountain View Road; thence S 0°27'22"W 60.00 feet to a point on the south right-of-way line of Mountain View Road; thence N 88°56'40"W 300.71 feet along said south right-of-way line of Mountain View Road to a point on the east right-of-way line of Mountain View Road; ORDINANCE 2004-36- Al'<'NEXATION I 025 N MEADOW VIEW ROAD PAGE I of2 ---PAGE BREAK--- thence N 0°25'22"E 60.00 feet along a northerly extension of said east right-of-way line of to a point on the north right-of-way line of Mountain View Road; thence N 88"56'40"W 30.00 feet along said north right-of-way line to the TRUE POINT OF BEGINNING. Said Parcel contains I 0.24 Acres, more or less. SECTION 2: ANNEXATION: The lands described in Section I of this Ordinance be and the same hereby is, annexed to the City of Moscow, Idaho and declared a part of the City of Moscow, Idaho; and the Moscow City Engineer is hereby ordered to make the necessary amendments to the official City maps for the City of Moscow, Idaho, which are on file at 221 East 2"d Street. SECTION 3: SEVERABILITY: Provisions of this Ordinance including every exhibit subpart of Section 1 of this Ordinance, shall be deemed severable and the invalidity of any provision of this Ordinance including any exhibit subpart of Section 1 of this Ordinance, shall not affect the validity of remaining provisions or subparts. SECTION 4: EFFECTIVE DATE: This Ordinance shall be effective upon its passage, approval and publication according to law.
