RESOLUTION NO. 89-23 A RESOLUTION OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF IDAHO, ESTABLISHING A POLICY ON THE USE OF SAFETY RESTRAINT DEVICES BY CITY EMPLOYEES IN CITY VEHICLES. WHEREAS, the City of Moscow is concerned with safety of its employees; and YrBEREAS, considerable injuries received in an vehicle occupants are restraint devices; and data exist that the severity of automobile accident are reduced when properly wearing vehicle safety WHEREAS, the Idaho Legislature has passed a law reqUJ.rlng the use of safety restraint devices in certain vehicles; and WHEREAS, the City of Moscow recognizes that compliance by employees with safety restraint laws provides a positive example of driving safety for our citizens; NOW THEREFORE, BE IT RESOLVED BY THE MAYOR MlD CITY COUNCIL OF THE CITY OF MOSCOW. SECTION 1: The City Council hereby modifies the personnel rules of the City of Moscow as follows: Safety Restraint Use. Each occupant of a city owned motor vehicle which was manufactured with safety belts in compliance with Federal Motor Vehicle Standard No. 208 shall have a safety belt properly fastened about his/her body at all times when the vehicle is in motion except: A. When an occupant of a motor vehicle possesses a written statement from a licensed physician or his/her department head that he/she is unable, for medical or physical reasons, to wear a safety belt. B. When in a specific circumstance the use of safety restraints may hamper the efficient or safe conduct of police or r J.re functions. These specific incidents will be pre-approved by a supervisor who shall consider the the and -the at ---PAGE BREAK--- c. When the gross vehicle weight is greater than 8 ,000 pounds and, in the opinion of the supervising department head, the use of safety restraints will hamper the efficient conduct of the activity to such an extent that the safety benefit is greatly outweighed. Decals indicating that the use of safety restraints is required will be affixed to the dash of all city vehicles. ADOPTED by the Council and APPROVED by the Mayor this 6th day of November , 19 8 9 .
