The subgrade contamination was discussed at ength. Again, for the overall betterment of the project, a compromise was agreed to where the owner will share the cost of the silbgrade repair to a maximum amount of $1,400. 3. The above two items will be included, along with Cbange Proposals 1 and 2, in Cbange Order No. 1 which will be submitted with this month's Pay Request. The Change Order will require City Council approval. The City wished to make it clear that the above compromises for weather delays and subgrade damage are not to be considered as a precedent for future claim resolutions or resolution process, but have been agreed to for the overall betterment of the project. 4. Per Wind River's letter of 22 December: Item 1, Square Tubing: Wind River shall investigate the construction challenges given round or square columns. These include structural connections and Heater Unit mounting details. Item 2, Pipe Chase: The vent pipes shall be located in the masonry walls per the Contract Documents. Item 3, Subgrade damage: See 2. above. Item 4, Foundation Drains: Wind River agreed to include this claim in with the subgrade compromise above at no additional cost to the owner. Mise: BAU coordinated grate and conditions on site with Bob 22 December 199d.
