AMENDMENT NUMBER 1 TO THE UNIVERSITY OF IDAHO SERVICE CONTRACT NUMBER Ul-678 This Amendment (the Amendment) is made and entered into, effective as of January 1, 2012 (the Effective Date), by and between the City of Moscow ("the Contractor"), and the Regents of the University of Idaho (the University), concurrently with and as an Amendment to Contract Number UI-678 (the Agreement). In the event of any conflict between the terms of this Amendment and the original Agreement to which it is amended, the terms of this Amendment will supersede the terms of the original Agreement and will be controlling. The term "Agreement," as used herein, will collectively refer to Contract Number UI-678 as modified by this superseding Amendment. RECITALS The University of Idaho wishes to provide a secure and safe location for students to store firearms while in residence. Firearms are prohibited on University property except as provided in the University ofldaho Administrative Procedures Manual (APM) section 35.35 paragraph H. The City of Moscow through its Moscow Police Department (MPD) has the expertise and experience to provide administrative service for the campus gun locker and is currently providing such service through its community policing unit assigned to and stationed on campus. 1.1 TERM OF AGREEMENT The MPD gun locker service provision period is extended through June 20, 2014. All existing terms and conditions of this contract remain unchanged. 1.2 EXHIBIT A: SCOPE OF WORK Exhibit A: University of Idaho Gun Locker Basic Weapon Check In/Check Out Procedures is attached and incorporated by reference. 1.3 ENTIRE AGREEMENT This Amendment along with the original Service Contract Number UI-678 constitutes the entire Agreement between the parties. No change thereto shall be valid unless communicated in writing in the stipulated manner and signed by the University and the Contractor. Johnson Director, Contracts and Purchasing Services Date CITY OF MOSCOW Gary Riedner City Supervisor Date ---PAGE BREAK--- UNIVERSITY OF IDAHO GUN LOCKER BASIC WEAPON CHECK IN/CHECK OUT PROCEDURES The University of Idaho (UI) desires to allow Ul students and staff to store legal firearms at a gun locker, located within 880 West 3rd St. Moscow, Idaho (Gun Locker) and has contracteq with the City of Moscow, Idaho Police Department (MPD) to provide the services set out herein p\Jrsuaht to University of Idaho Agreement Number Ul-678 under the conditions contained herein. These gun locker services will be provided to Ul by MPO for a period of one year beginning on the first dńy of Agreement Ul-678, after which, the services will be assessed by Ul and MP"D before such service continues to be provided. CONDITIONS AND PROCEDURES: Ownership and Use of the Gun Locker. Ul is the sole owner of the Gun Locker. Only Ul students and staff will be allowed to have tneir weapons stored in the Gun Locker. If Ul ceases to utilize 880 West 3'd Street as the location of the Gun Locker, Ul shall provide another facility on campus for such Gun Locker and shall, at Ul's sole expense, install a call box at such location. MPD will provide the services herein at such new Gun Locker location. Ul and MPD understand and agree that MPD provides the services herein onl_y_:as per Agreement Ul-678. Check In/ Check Out Procedure. UJ students and staff must be physically present at and must utilize the call box -at 880 West 3rd Street to contact MPD dispatch (WHITCOM) to request MPD to help them check in or check out weapons at the Gun Locker. Following a dispatch request through WHITCOM for Gun Locker services, MPD personnel will respond to such rE;Jquest at 880 West 3rd Street, as their schedule allows. Gun Locker services will be provided at all times (day or night) during the hours MPD personnel are scheduled to be present on Ul campus. MPD Gun Locker service response times may vary, depending on then-current call load. After MPD arrives at the Gun Locker to provide Gun Locker services, the weapons will be inspected. Weapons stored shall not be loaded, shall be stored in a case, and shall be locked using a gun lock. A gun lock can be provided, if necessary. Ammunition will not be stored in the Gun Locker. Under NO ·circumstances will Ul students or staff enter the building at 880 West 3rd Street with a weapon without a proper escort. To be provided Gun Locker services, all Ul students and staff shall present a current and valid state identification and a current and valid University identification at the time of check in or· check out. As a condition of use ·of Gun Locker services, every Ul student and staff member shall waive any claim against MPD, City of Moscow, Idaho and its officials, staff, agents, and representatives, except as provided in University of Idaho Agreement No. Ul-678. Failure to comply with these conditions or procedures by Ul students or staff may result in the tennination of Gun Locker services for such Ul students or staff, solely as detŅrmined by MPO".
