PROJECT: OWNER: AGREEMENT FOR PROVISION OF SECURITY FOR EROSION AND SEDIMENT CONTROL SIL VER CREEK APARTMENTS :__PHASE II 2020 White Avenue, Moscow, Idaho Merrell Enterprises Merrell Enterprises (hereinafter 'OWNER), the developer and responsible party for the grading of The Silver Creek Apartments Phase II Development, a twenty four (24) unit residential complex located at 2020 White A venue, in the City of Moscow (hereinafter "CITY"), agrees that the cash security in the amount of three thousand three hundred fifteen dollars ($3,315) furnished to CITY in accordance with the provisions of Section 3316.3.6 of CITY's Erosion and Sediment Control Ordinance (Ord. No. 98-1) will be held by CITY until erosion and sediment control of the disturbed areas of the site is complete and 'established' in accordance with the provisions of said Ordinance and in accordance with the approved grading and erosion and sediment control plan. OWNER agrees that erosion and sediment control as set forth m the Ordinance is OWNER's full obligation and responsibility. Should OWNER fail to complete and maintain such control in accordance with the requirements set forth in the Ordinance, CITY may utilize the three thousand three hundred fifteen dollars ($3,315) security to pay the costs to accomplish and/or maintain erosion and sediment control on this site.
