RESOLUTION 2003 - 07 Pursuant to the provisions of Idaho Code 50-344, City of Moscow, Idaho (hereinafter referred to as "City") is authorized to maintain and operate solid waste systems. For purposes of solid waste services, the City Council has made written findings herein dated September 2, 2003 that it is necessary for the public health, safety and well-being of the citizens of City that City enter into a non-exclusive franchise agreement for solid waste services. The Council's findings include the following: l. That it is necessary for City to improve and develop a reliable program relating to the collection, disposal, recovery and management of solid wastes with City; 2. To provide for safe and sanitary accumulation, collection, transportation, storage and disposal, including resource recovery of wastes and solid wastes; 3. To prevent uncontrolled dumping of wastes and solid wastes on public and private property; 4. To provide a planning implementation method for adequate waste and solid waste control, disposal and recovery; 5. To develop a program of control of waste and solid waste in accordance with Federal, State and local agencies responsible for the prevention, control or abatement of air, water and ground pollution; 6. To provide lor sanitary, efficient and economical ways of waste and solid waste collection, disposal and recovery; 7. To provide minimum standards for collection of waste and solid waste and for disposal or recovery thereof; 8. To provide for technologically and economically feasible resource recovery; and 9. To prevent the unlawful storage, deposit or display on private property, of wastes or solid wastes that are hazardous to the health or safety of the public, that create offensive odors, that create a condition violative of any stature, administrative rule, ordinance, order or resolution or any provision thereof, that creates a fire hazard, and/or that storage, collection, maintenance of display of wastes or solid wastes in violation of this subsection shall be considered a public nuisance.
