150181 PERMANENT UNDERGROUND UTILITY EASEMENT KNOW ALL MEN BY THESE PRESENTS, that TIMOTHY S. HILLEBRAND and ROMANA P. HILLEBRAND, husband and wife, whose current address is 857 Orchard Avenue, Moscow, Idaho 83843, (GRANTORS) owners of real property affected hereby, in consideration of one dollar and other valuable consideration in hand paid, do hereby grant the CITY OF MOSCOW, a municipal corporation of the State of Idaho, 206 East Third Street, Moscow, Idaho 83843, (GRANTEE), and its agents and assigns, a permanent easement and right-of-way in which to construct and maintain underground utilities including the right to enter upon, occupy and use property located in the City of Moscow, Latah County, Idaho, to wit: A portion of that parcel of land located in the northwest quarter of the northeast quarter of Section 8, Township 39 North, Range 5 West, Boise Meridian, Latah County, Idaho and described in Quit Claim Deed No.443273 on file with the Recorder's office of said county, said portion being more particularly described as follows: Beginning at the southwest corner of said parcel, said point also being the northwest corner of Lot 8, Block 1 of the Tower Addition to the City of Moscow, Idaho, recorded in Book 5 of Plats, page 27, on file with the recorder's office of said county; thence North 32.52 feet along the west boundary of said parcel and along the east boundary of Lot 5, Block 1 of said Tower Addition; thence S59°43'57"E 66.64 feet to a point on the south boundary of said parcel and the north boundary of Lot 8, Block 1 of said Tower Addition; thence N88°56'00"W 57.57 feet along said south boundary to the southwest corner of said parcel and the point of beginning. For the purpose of constructing, operating, maintaining, and repairing or replacing underground utilities by the City of Moscow or its agents or contractors or franchised utility companies. The GRANTORS, their successors and assigns, reserve the right to improve said easement area as long as such improvement shall not unreasonably interfere with the construction, operation, main!enance, repair and/or reconstruction of the utilities. The GRANTORS agree that they and their heirs or assigns will not build or place any new encroachment thereon which will unreasonably interfere with the right of the GRANTEE. The GRANTEE, its agents or transferees, shall have the right to perform any maintenance it may deem necessary or wish to exercise in connection with the aforesaid utilities (including, but not limited thereto, the right to make necessary repairs, alterations, and removals or replacement thereof). Upon exercising these rights, GRANTEE shall restore the property to its prior condition and shall compensate GRANTORS, their successors or assignees, for any damages suffered.
