ORDINANCE NO. 2000-02 AN ORDINANCE OF THE CITY OF MOSCOW, A M(J]\,iCIP AL CORPORATION OF IDAHO; PROVIDING THAT LANDS DESCRIBED IN SECTION I OF THIS ORDINANCE BE ANNEXED TO THE CITY OF MOSCOW; PROVIDING THAT THE PROVISIONS OF THIS ORDINANCE BE DEEMED SEVERABLE; PROVIDING FOR THIS ORDINANCE BE TO BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PAS SAGE, APPROVAL, AND PUBLICATION ACCORDING TO LAW. WHEREAS, lands described in Section I of this Ordinance are adjacent to the City of Moscow; and WHEREAS, the owners of said land have requested the City to annex said lands; and WHEREAS, Idaho Code Section 50-222 authorizes city annexation of land adjacent to the City with or without the request of the landowner; and WHEREAS, the lands described in Section l of this Ordinance can be served by City sewer and City water; and WHEREAS, the City of Moscow Planning and Zoning Commission held a duly noticed public hearing on this matter on January 12, 2000, and recommended that the Moscow City Council approve this annexation; and WHEREAS, the Moscow City Council held a duly noticed public hearing and voted to approve this annexation on February 22, 2000. NOW, THEREFORE, BE IT ORDATNED BY THE MAYOR AND COUNCIL OF THE CITY OF MOSCOW, IDAHO AS FOLLOWS SECTION I LEGAL DESCRIPTION This Ordinance shall apply to the following described parcel of land located in Moscow, Latah County, Idaho, to wit A tract of land located in the southwest quarter of the southwest quarter of Section 5, the northwest quarter of the northwest quarter of Section 8, the northeast quarter of the northeast quarter of Section 7, the southeast quarter of the southeast quarter of Section 6, all in Township 39 North, Range 5 West, Boise Meridian, Latah County, Idaho, and more particularly described as follows: Beginning at the southwest corner of said Section 5; thence N0°50'25"E 224.66 feet along the west line of said Section 5 to a point on the existing Moscow city limit boundary and the TRUE POINT OF BEGINNING; thence S89°14'23"E 50.73 feet along said city limit boundary to a point on the easterly right-of-way line of U.S Highway 95; thence continuing along said city limit boundary, S88°50'54"E 270.28 feet; thence SOI006'44"W 225.00 feet along said city limit boundary; thence N88°50' 54"W 263.90 feet along said city limit boundary to a ORDINANCE 2000-02 Page I of 2 ---PAGE BREAK--- point on said easterly highway right-of-way line; thence S0°45'37"W 733.05 feet along said right-of-way line and along said city limit boundary to the northwest corner of the Roscoe Williams tract shown on Record of survey Instrument No 392716 on file with said recorder's office; thence leaving said city limit boundary S0°45'37"W 256.84 feet along said right-of-way line to a point on said city limit boundary; thence N89°l 4'23"W 1 15.00 feet along said city limit boundary to a point on the westerly right-of-way line of said Highway 95, said point being the northeast corner of Lot I 0, Block I of Loney's Addition to the City of Moscow, recorded in Book 4 of Deeds, page 37; thence N0°45'37"E 750.00 feet along said right-of-way line and along said city limit boundary to the northeast corner of said Loney's Addition; thence continuing along said right-of-way line N0°45'37"E 206.94 feet along said city limit boundary to the southeast corner of the Henry Brandt tract described in Book 109 of Deeds, page 412; thence leaving said city limit boundary, N0°45'37"E 257.99 feet along said right-of-way line to a point on said city limit boundary; thence S89° 14'23"E 59.27 feet along said city limit boundary to the TRUE POINT OF BEGINNING. Said tract contains 4.57 acres, more or less. SECTION 2 ANN'EXATION That the lands described in Section 1 of this Ordinance be and the same hereby are, annexed to the City and declared a part of the City of Moscow. SECTION 3: SEVERABILITY: Provisions of this Ordinance shall be deemed severable and the invalidity of any provision of this Ordinance shall not affect the validity of remaining provisions. SECTION 4 EFFECTIVE DATE This Ordinance shall be effective upon its passage, approval, and publication according to law.
