447521 VACATION OF PERMANENT EASEMENT AND QUITCLAIM Brian Claypool, 336 Styner Avenue, Moscow, Idaho, 83843, and Denise Claypool, 418 E. 8th Street Moscow, Idaho, 83843 (GRANTORS), owners of real property described herein, for and in the consideration of one dollar and other valuable consideration in hand paid, receipt of which is hereby acknowledged, do release, waive, vacate and terminate the permanent easement and right-of-way over, under, across and along the northerly 25 feet of an existing 50 foot wide access easement described in Warranty Deed No. 400633 on file with the Latah County, Idaho Recorders office and located in the northwest quarter of the southwest quarter of Section 17, Township 39 North, Range 5 West, Boise Meridian, Latah County, Idaho (as shown in Exhibit attached), said portion being more particularly described as follows: Beginning at the northwest corner of said northwest quarter of the southwest quarter of Section 17; thence S89°20'34"E 988.40 feet along the north line of said northwest quarter of the southwest quarter; thence S0!008'46"W 184.16 feet to the southwest corner of the Claypool tract as described in Warranty Deed No. 400633 on file with said Recorder's office and shown on Baune & Hodge survey for Bill Patterson, Record of Survey Inst. No. 310967 also on file with said Recorder's office; thence S86°37'26"E 124.21 feet along the south boundary of said Claypool tract; thence NOI008'46"E 49.82 feet along the east boundary of said Claypool tract to the centerline of said existing 50 foot wide access easement and the TRUE POINT OF BEGINNING; thence NOI008'46"E 25.18 feet continuing along said east boundary to the northeast corner of said Claypool tract; thence S82°02'20"E 159.39 feet along the northerly boundary of said easement; thence SO I 008'46"W 25.18 feet parallel with and 60 00 feet westerly from (as measured perpendicularly) the east line of the northwest quarter of the southwest quarter of said Section 17 to said easement centerline; thence N82°02'20"W 159.39 feet along said centerline to the TRUE POINT OF BEGINNING. Said parcel contains 3985 square feet, more or less. Said Vacation of Easement and Quitclaim shall include any right to enter thereon for any purpose whatsoever. This Vacation of Easement and Quitclaim is also accompanied by GRANTORS' acknowledgment that they have remised, released, and quitclaimed and by these presents, do remise, release and quitclaim unto City of Moscow, Idaho, a municipal corporation of Vacation of Permanent Easement and Quitclaim Page l of 3 ---PAGE BREAK--- 447521 the State of Idaho, 206 East 3rd Street, Moscow, Idaho, 83843 (GRANTEE), and its heirs, agents and assigns forever all the right, title, interest, claim and demand which said GRANTORS have individually and in common in and to the herein described lot, piece or parcel of land. TO HAVE AND TO HOLD THE SAME, together with all and singular, the appurtenances thereunto belonging or in anywise appertaining, and all the real estate, right, title, interest and claim whatsoever of GRANTORS, either in law or equity, to the proper use, benefit and belief of GRANTEE, its heirs, agents, and assigns, forever.
