RESOLUTION NO. 91-10 A RESOLUTION OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, APPROVING THE MODIFICATION OF IMPROVEMENTS ON RAYBURN STREET BETWEEN STATE HIGHWAY 8 AND PARADISE CREEK STREET; PROVIDING FOR THIS RESOLUTION TO BE IN FULL FORCE AND EFFECT UPON ITS PASSAGE AND APPROVAL. WHEREAS, the University of Idaho has made a request to the City of Moscow to modify the improvements which will encroach on Rayburn Street; and WHEREAS, the new improvements will consist of constructing a new curb on the west side of the street approximately 14 feet to the east of the existing curb and eliminating on-street parking on this portion of Rayburn Street; and WHEREAS, the City Engineer has reviewed the plans for traffic control for the modified improvements; and WHEREAS, the City Council held a public hearing on this matter on May 6, 1991; NOW THEREFORE IT IS HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MOSCOW AS FOLLOWS: SECTION 1: The City of Moscow hereby approves the proposed modifications to Rayburn Street between Idaho State Highway 8 and Paradise Creek Street as indicated on the attached plans. SECTION 2: It is specifically found by the city Council that Rayburn Street in this area has never been dedicated to the city, nor has the City ever accepted any responsibility for or liability for this street. Nothing herein shall be interpreted as dedication, an acceptance said right-of-way, or as an acceptance of responsibility for or liability for said right-of-way. SECTION 3: EFFECTIVE DATE: This resolution shall be effective upon its passage and approval by the City Council. RESOLVED by the Council and APPROVED by the Mayor this 6th day of May, 1991. ATTEST:
