ORDINANCE NO. 2001-32 AN ORDINANCE OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, PROVIDING THAT LANDS DESCRIBED IN SECTION 1 OF THIS ORDINANCE AND SHOWN ON EXHIBIT HERETO BE ANNEXED TO THE CITY OF MOSCOW; PROVIDING THAT THE PROVISIONS OF THIS ORDINANCE BE DEEMED SEVERABLE; PROVIDING FOR THIS ORDINANCE TO BE IN FULL FORCE AND EFFECT FROM AND AFTER PASSAGE, APPROVAL AND PUBLICATION ACCORDING TO LAW. WHEREAS, the Moscow Mayor and City Council adopted Resolution 2001-15 which established annexation standards and guidelines creating an annexation policy; and WHEREAS, lands described in Section 1 of this Ordinance and shown on Exhibit hereto are adjacent to and surrounded by the City of Moscow, Idaho; and WHEREAS, Idaho Code Section 50-222 authorizes city annexation of tracts of land adjacent to and surrounded by the City; and WHEREAS, the Moscow Mayor and City Council held a public meeting regarding this matter on July 2, 2001; and WHEREAS, the Moscow Mayor and City Council held a public meeting regarding this matter on December 3, 2001; and WHEREAS, the Moscow Mayor and City have determined that annexation of lands described in Section I of this Ordinance and shown on Exhibit hereto as Parcel 8 is appropriate and is consistent with Council policy established in Resolution 2001-15; and NOW THEREFORE, be it ordained by the Mayor and Council of the City of Moscow as follows: SECTION I: LEGAL DESCRIPTION: This Ordinance shall apply to the following described lands in Moscow, Latah County, Idaho, to-wit: ParcelS A tract of land located in the southwest quarter of the southwest quarter of Section 9 and the southeast quarter of the southeast quarter of Section 8, Township 39 North, Range 5 West, Boise Meridian, Latah County, Idaho, more particularly described as follows: Beginning at the northwest corner of the southwest quarter of said Section 9; thence South 1320 feet along the west line of said Section 9 to the northwest corner of the southwest quarter of the southwest quarter of Section 9, said point being the TRUE POINT OF BEGINNING; thence West 165.00 feet along the north line of said southwest quarter of the southwest quarter to the northeast corner of a parcel of land described in Warranty Deed No. 378805 on file with the Recorder's office of said Latah County; thence S67°0 1 'W 179.00 feet along the boundary of said parcel to the west line of said Section 9; thence West 30.00 feet to the westerly right-of-way line of Mountainview Road; thence North 70.00 feet along said right-of-way line to the north boundary of the southeast quarter of the southeast quarter of said Section 8; thence East 30.00 feet along said north line to the TRUE POINT OF BEGINNING. Ordinance 200 l-32 Annexation ---PAGE BREAK--- SECTION 2: ANNEXATION: The lands described in Section l of this Ordinance and shown on Exhibit hereto as ParcelS be and the same hereby are, armexed to the City of Moscow, Idaho and declared a part of the City of Moscow, Idaho; and the Moscow City Engineer is hereby ordered to make the necessary amendments to the official City limits map, zoning map, and Area of City Impact map for the City of Moscow, Idaho, which are on file at City Hall. SECTION 3: SEVERABILITY: Provisions of this Ordinance including every exhibit subpart of Section I of this Ordinance, shall be deemed severable and the invalidity of any provision of this Ordinance including any exhibit subpart of Section 1 of this Ordinance, shall not affect the validity of remaining provisions or subparts. SECTION 4: EFFECTIVE DATE: This Ordinance shall be effective upon its passage, approval and publication according to law.
