ORDINANCE NO. 2001-15 AN ORDINANCE OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, PROVIDING THAT LANDS DESCRIBED IN SECTION l OF THIS ORDINANCE BE ANNEXED TO THE CITY OF MOSCOW; PROVIDING THAT THE PROVISIONS OF THIS ORDINANCE BE DEEMED SEVERABLE; PROVIDING FOR THIS ORDINANCE TO BE IN FULL FORCE AND EFFECT FROM AND AFTER PASSAGE, APPROVAL AND PUBLICATION ACCORDING TO LAW. WHEREAS, land described in Section l of this Ordinance is adjacent on three sides to the City of Moscow, Idaho; and WHEREAS, Idaho Code Section 50-222 authorizes City annexation of land adjacent to the City; and WHEREAS, the Moscow Planning and Zoning Commission held a duly noticed public hearing regarding this matter August 8, 200 l ; and WHEREAS, the Moscow Mayor and City Council held a duly noticed public meeting regarding this matter on September 4, 200 l ; and WHEREAS, the owners of said land do not object to its annexation. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF MOSOCW, IDAHO AS FOLLOWS: SECTION 1: LEGAL DISCRIPTION: This Ordinance shall apply to the following described land in the City of Moscow, Latah County, Idaho, to-wit: A tract of land located in the southeast quarter of the southeast quarter of Section 5, Township 39 North, Range 5 West, Boise Meridian, Latah County, Idaho, and being more particularly described as follows: Beginning at a point on the east line of said Section 5, said point being 165.00 teet south of the northeast comer of said southeast quarter of the southeast quarter of Section 5; thence continuing south 330.00 feet along said east line; thence West 1275.00 feet along the north boundary of the Amended Plat of Evergreen Hills Addition to the City of Moscow, as recorded in Book 6 of Plats, page 18 with the Recorder's office of said Latah County, to the southeast comer of an easement described in Instrument No. 285532 on file with said Recorder's office; thence N07°07'30"W 120.93 feet along said easement to a point on the east right-of-way line of Orchard Avenue; thence North 210.00 feet along said right-of-way line to the north line of a tract of land described in Instrument No. 269235 on file with said Recorder's office; thence East 1290.00 feet along said north line to the point of beginning. Said tract contains 9.75 acres. SECTION 2: ANNEXATION: The land described in Section I of this Ordinance be and the same hereby is, annexed to the City of Moscow, Idaho and declared a part of the City of Moscow, Idaho; and the Moscow City Engineer is hereby ordered to make the necessary amendments to the official City maps for the City of Moscow, Idaho, which are on file at City Hall. SECTION 3: SEVERABILITY: Provisions of this Ordinance shall be deemed severable and the invalidity of any provision of this Ordinance shall not affect the validity of remaining provisions.
