308893 ORDINANCE NO. 1425 AN ORDINANCE ANNEXING CERTAIN LANDS PARTICULARLY DESCRIBED IN SECTION 2 OF THIS ORDINANCE OF THE CITY OF MOSCOW, IDAHO; PROVIDING THAT THE CITY MAP AND THE COMPREHENSIVE PLAN OF THE CITY OF MOSCOW, IDAHO BE AMENDED ACCORDINGLY AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF MOSCOW, IDAHO: WHEREAS, the land described in Section 2 of this Ordinance is land lying adjacent to the City of Moscow, Idaho; and whereas said land is in tended and can reasonably be assumed to be used for the orderly develop ment of the City of Moscow, Idaho; and whereas the owners of said land have requested in writing of the Council of the City of Moscow, Idaho, that said land be annexed to the City of Moscow, Idaho; SECTION 1. ANNEXATION. That the land described in Section 2 of this Ordinance be and the same hereby is annexed to the City of Moscow, Idaho, and that said land be and the same hereby is declared a part of the City of Moscow, Idaho. SECTION 2. DESCRIPTIONS. That the land annexed to and declared to be a part of the City of Moscow, Idaho, by this Ordinance is situated in Latah County, State of Idaho, and is more particularly described as follows, to- wit: Parcel 1: Lot 11 of Cosner Subdivision of Portions of Lots D and E of the Schumacher Addition to Latah County, Idaho. EXCEPTING THEREFROM: beginning at a point on the North line of Lot 11 of Cosner's Subdivision of portions on Lots D and E of the Schumacher Addition to Latah County, Idaho, and 316.55 feet S. 89° 17' E of the Northwest corner of said Lot 11, and running thence South a distance of 136.5 feet, more or less, to a point of intersection with the North line of Lot 5 of said subdivision, and said point of inter section being located 109.8 feet N. 89° 20' W of the North east corner of said Lot 5; thence S. 89° 20' E. a distance of 234.7 feet along the North line of said Lot 5 and of Lot 7 of said subdivision to the Northeast corner of said Lot 7; thence North a distance of 17.54 feet to the Northwest Corner of Lot 9 of said subdivision; thence S. 89° 20' E. a distance of 80 feet to the Southeast corner of said Lot 11; thence North a distance of 118.76 feet, more or less, along the East line of said Lot 11 to the Northeast corner of said Lot 11; thence N. 89° 17' W. a distance of 313.7 feet along the North line of said Lot 11 to the point of beginning. Parcel 2: Schumacher's Addition W t of N t of Lot E Parcel 3: Beginning at the Southwest corner of Lot 11 of Cosner Subdivision of portions of Lots D & E of the Schumacher' s Addition to Latah County as shown by the recorded plat thereof and running thence N. 89° 20' W. 60.0 feet to the West right-of way line of Mountain View Road; thence North 315.68 feet, along said right-of-way line to the Northwest corner of the intersection of Thatuna Avenue and Mountain View Road, thence S. 89° 17' E ---PAGE BREAK--- 376.55 feet, along the North right-of-way line of Mountain View Road (County Road); thence South 60.0 feet to the South right-of-way line of said road; thence N 89° 171 W 316.55 feet, along said right-of-way line and/or the North line of Lot E of Schumacher•s Addition to the Northwest corner of said lot; thence South 255.68 feet, along the West lines of Lots E & D of said Schumacher•s Addition, to the point of beginning. SECTION 3. The City Engineer of the City of Moscow, Idaho be and is hereby ordered and directed to make the necessary amendments to the Official City Map, the Zoning Map and the Comprehensive Plan Map of the City of Moscow, Idaho, of which maps are on file at the City Hall at the City of Moscow, Idaho, to provide that said area is to be henceforth a part of the City of Moscow, Idaho. SECTION 4. PUBLICATION. That this Ordinance shall be published in one issue of the official newspaper of the City of Moscow, Idaho. SECTION 5. EFFECTIVE DATE. That this Ordinance shall be effective from and after the date of its passage and approval and the publication thereof in the aforesaid official newspaper of the City of Moscow, Idaho.
