Memorandum of Understanding for One Year Pilot Parking Program This Memorandum Of Understanding (MOU) is made by and between the CITY OF MOSCOW, Idaho, a municipal corporation of the State of Idaho ("City") and THE REGENTS OF THE UNIVERSITY OF IDAHO, a public corporation, state educational institution and body politic and corporate organized and existing under the Constitution and laws of the State of Idaho. ("University") Whereas City and University are interested in establishing a one year Pilot Program to allow University to provide parking enforcement services for City on certain City streets and public rights-of-way as identified on the attached map; and Whereas Moscow City Council has taken action allowing University to enforce parking regulations on certain City streets and public rights-of-way. Therefore in consideration of the mutual promises below, City and University agree as follows: 1.0. UNIVERSITY'S OBLIGATIONS 1.1 Scope of University's Authority University will administer City's enforcement of City's parking scheme on City streets and public rights-of-way within the area in and around University and as identified on the map incorporated as Attachment A. 1.2 University's Parking Regulations University's parking regulations, incorporated as Attachment B, detail University's process and rules for enforcement, collection, and issuance of parking permits in the areas covered by this MOU. Permits issued by University for City streets and public rights-of-way will be Purple and Magenta and such permit holders shall be subject to all University parking regulations applicable to other University permit holders, except as discussed herein below. 1.2.1 Exemptions to the Purchase of Permits The following vehicles and property owners or occupants are not required to purchase University permits in order to park in the Purple or Magenta parking areas: 1.2.1.1 All properly marked federal and state vehicles. 1.2.1.2 Residents living in property adjacent to Purple and Magenta parking areas who are not registered students at the University. University/City of Moscow Pilot Parking Program MOU -August 2001 Page 1 of 5 2001-36 ---PAGE BREAK--- 1.3 Dedicated City Streets University acknowledges that this MOU is not intended to be construed in any way to void, limit or restrict the City's authority over dedicated City streets or public rights-of-way. 1.4 Use of Revenue University agrees that revenues generated from parking enforcement encompassed by this MOU shall be specifically accounted for and spent exclusively on maintenance and improvement of City streets and public rights-of way described in Attachment C. 1.5 Parking and Traffic Control Signs University shall install and maintain traffic and parking control devices on designated City streets and public rights-of-way described in Attachment A in accordance with the Manual on Uniform Traffic Control Devices and applicable state and local laws. City Director of Public Works shall approve regulatory traffic and parking devices on city streets and public rights-of-way before being posted by the University. University shall correct any inadequate or improper signage or markings at the direction of City Director of Public Works. 1.6 Hold Harmless and Indemnification 1.6.1 University shall hold harmless, indemnify and defend City from all losses. claims, actions, judgments for damages, or injury to persons or property and losses and expenses caused or incurred by University, its servants, agents, employees, guests and business invitees arising from the performance of this MOU. This hold harmless, indemnification and defense does not apply when such claims, actions, judgments for damages, or injury to persons or property and losses and expenses are the wholly or in part the result of negligent acts, errors, omissions or fault on the part of City, its agents or assigns other than University. 1.6.2 University's liability coverage is provided through a self-funded liability program administered by the Idaho Office of Insurance Management. Limits of liability, and of University's indemnification under this Agreement with respect to claims covered by the Idaho Tort Claims Act, are $500,000 Combined Single Limits, which amount is University's limit of liability under the Idaho Tort Claims Act. 1.6.3 The University shall notify City of any such claim of which it has knowledge, and shall cooperate fully with City or its representatives in the defense of the same. University/City of Moscow Pilot Parking Program MOU -August 2001 Page 2 of5 ---PAGE BREAK--- 1. 7 Reporting Obligations University will provide a report to City every three months (December 31, March 30, June 30, and September 30) which report shall include the following information: 1.7.1 The number of parking permits sold for City streets and public rights-of way, 1.7.2 Revenue from permits sold for City streets and public rights-of-way, 1.7.3 Revenue generated from collection of tickets for City streets and public rights-of-way, 1.7.4 Location and amount of each ticket for parking violations on City streets and public rights-of-way, 1.7.5 Percentage of total parking ticket revenue collected from tickets for City streets and public rights-of-way. 2. CITY'S OBLIGATIONS 2.1. Grant of Authority University employees are hereby granted the authority to issue tickets or citations and to enforce City parking regulations on all City streets and public rights-of-way shown on Attachment A in the same manner as it does for all other parking areas regulated by University, as described in Attachment B, except as specifically provided for in this MOU. 2.2 Continuing Assessment City will independently assess the advisability of having a non-City entity controlling public rights-of-way. 3. GENERAL TERMS 3.1 Remaining Issues City and University will resolve remaining issues of enforcement and maintenance identified by City and University staff during this Pilot Program, which include: 3.1.1 Resolving non-parking enforcement issues. 3.1.2 Clarifying long-term street maintenance within City streets and public rights-of-way shown on Attachment A. University/City of Moscow Pilot Parking Program MOU-August 2001 Page 3 of 5 ---PAGE BREAK--- 3.1.3 Clarifying emergency access needs to all areas occupied by University buildings and University-related residences. 3.1.4 Exploring a collection process that benefits both University and City. 3.2 Additional Acts Except as otherwise provided herein, the parties to this MOU shall perform, execute and/or deliver or cause to be performed, executed and/or delivered any and all such further acts and assurances as any party to this MOU may reasonably require to execute the promises in this MOU 3.3 Notices Any notice under this MOU shall be in writing and be delivered in person or by public or private courier service (including U.S. Postal Service Express Mail) or certified mail with return receipt requested or by facsimile. Actual notice, however and from whomever received, shall always be effective. 3.4 Term This Agreement shall expire on July 31, 2002 but may be renewed by written agreement of the parties. 3.5 Headings The headings contained in this MOU are for reference purposes only and shall not in any way affect the meaning or interpretation hereof. INTRODUCTION The Parking Services program at the University of Idaho is a user-based system. Income derived from the sale of parking permits and from the collection of monetary penalties assessed under these regulations is used for the administration, maintenance, and improvement of parking facilities. The University of Idaho is considered a pedestrian campus. The campus core streets are closed to most traffic to provide for a pedestrian walkway system. Bicycles and motor vehicles that share the walkway must yield to pedestrians and observe a 5 MPH speed limit. Access permits are required year round, 24 hours a day to enter the Campus Walkway System. Access is granted for service vehicles, people with disabilities, and other essential functions on a case-by-case basis. Access Permits are available at the Parking office and after hours at the Moscow Police Department, 118 E. 4th Street, access is limited to 30 minutes or actual delivery time. General parking is prohibited in the campus core. Regulations are enforced at all times, 365 days per year. Exceptions to this enforcement will be prominently posted at individual colored areas, and/or posted on the Parking Services website. As a general rule, permits will NOT be required during Thanksgiving, Christmas, and Summer academic breaks, except in Gold and Green Family Housing lots. Regulations apply to all persons who park vehicles at the University of Idaho Moscow campus and in areas as designated by the parking map. Please observe the signs that designate permit parking zones. Information on co-jurisdiction with the City of Moscow is outlined in section G.3. 2 ---PAGE BREAK--- On special occasions and in emergencies, the University may temporarily alter these regulations or impose additional ones. Parking Services may preempt the use of certain lots or streets for special events and reserves the right to charge a fee for parking at these events. Changes to parking lots and regulations may occur without republishing these regulations. Posted signs, as well as information posted upon the Parking Services website, act as an advisory of regulations that are currently in effect. The University assumes no liability for loss of or damage to vehicles or their contents while on University property, or within University administered parking facilities. For questions or comments related to parking, please consult Parking Services at the North Campus Center, 645 W. Pullman highway, 885-6424. Lack of familiarity with the regulations does not constitute a defense for failure to comply with them. The purchase of a University Parking Permit DOES NOT guarantee an individual a parking space. The Parking Services office should be contacted immediately, in instances where any vehicle has been parked illegally/inappropriately in an individual parking space, which has been assigned/reserved by the University, and a permit has been purchased for that individual space use. B. GENERAL REGULATIONS/DEFINITIONS General Parking Regulations will be enforced at all times, 365 days per year. 1. NO PARKING ZONES: Parking is prohibited where restricted by signs, on landscaped areas, by yellow curbs, and where no parking space is defined. Parallel park with right wheels to the curb on normal two-way streets; while on one-way streets parking on left is acceptable. Spaces are defined by signs, markings on the pavement, parking bumpers (in gravel lots), or parking meters. 2. DISABLED SPACES: Only vehicles displaying officially recognized handicapped permits or license plates may use spaces designated for use as such. 3. TIMED SPACES: Designated timed spaces may be used by individuals for up to the posted time with no permit requirements. A vehicle may not be 3 ---PAGE BREAK--- moved within the same timed area just to avoid a penalty. Multiple citations may be issued for a continued violation. 4. OBSTRUCTING TRAFFIC: No vehicle, including service vehicles, may park in such a manner so as to impede access for emergency services, sanitation services, or in a manner which would unduly restrict pedestrian or vehicular traffic. 5. OVERSIZED VEHICLES PROHIBITED: Any vehicle larger than a standard sized, three quarter ton pickup truck must obtain permission by Parking Services and must be parked so that lines of sight necessary for safe driving are not blocked. 6. DISABLED VEHICLES: In the event of a disabled vehicle, notify the Parking Services office immediately (located in the North Campus Center, or call 885-6424). Vehicles, disabled or inoperative, for more than a 48-hour time period, even with a valid parking permit; will be towed. Vehicles are impounded as outlined in section G.6. 7. ILLEGAL USE: Display or possession of a permit for which the driver is not eligible, or any counterfeit or altered permit, constitutes an illegal use. Acquiring a permit under false pretenses invalidates that permit and constitutes an illegal use, when used and/or found on campus. 8. FAILURE TO COMPLY: Parking contrary to specific instructions from parking personnel, will constitute a violation subject to enforcement and monetary penalties. 9. RESTRICTED AREAS: Any area with access restricted as outlined in Section D. In addition, certain parking areas may be closed preceding special events and regulated according to the needs of that special event. 10. UNREGISTERED VEHICLES: All vehicles and trailers parked on University property must display current license plates and registration tags. All expired or unregistered vehicles are subject to citation or removal from University lots. 11. RESIDENTIAL PERMIT AREAS: Specified Residential Area Permits are required at all times in the Green, Silver, Purple, and Magenta parking zones. 12. SERVICE SPACES: Service spaces are restricted to Service permits only. Service permits are valid in service spaces, delivery spaces (time restrictions 4 ---PAGE BREAK--- apply), general pennit spaces, the campus walkway and meters. Temporary Service pennits will be issued on a case-by-case basis by Parking Office staff with time limitations. 13. Delivery spaces are intended to provide short term parking for deliveries by those with Delivery or Service pennits only. Posted time limitations are enforced in delivery spaces for all users. Temporary Delivery pennits will be issued on a case-by-case basis by Parking Office staff with time limitations. Delivery pennits are limited to 30 minutes on the campus walkway unless otherwise authorized. 14. LOST/STOLEN PERMIT: Use or display of an individual pennit recorded, as "lost/stolen" will constitute as "illegal" use, and subject to fine/enforcement (see "monetary penalty" schedule). Criminal prosecution may result. 15. FIRELANE: Parking in a fire lane by vehicles other than emergency vehicle is prohibited. Vehicles blocking or severely limiting emergency access will be towed (see G-6). C. DAYTIME REGULATIONS Daytime regulations are enforced Monday thru Friday, 7:30 a.m. to 6:00 p.m. except in Residential areas where pennit hours are in effect at all times. Daytime Regulations are enforced, in addition to, general regulations and definitions. 1. PERMITS REQUIRED: A vehicle parked in a permit area must properly display a valid permit. Pennits may be transferred to any properly recorded vehicle, but not to another person. Tax-exempt vehicles (State, federal, and local) are generally exempt from parking pennit requirements Exempt vehicles must observe no-overnight parking regulations. Contact Parking Services for identified locations for storage of department vehicles. 2. RESERVED SPACES: All vehicles that park in a reserved space must display a gold pennit or Tax exempt license plate authorized for that parking place. A private vehicle may not park in a place restricted to University vehicles unless a Department pennit is displayed. 3. METERS: A vehicle may be parked in a metered space only as long as the meter dial shows time remaining, or when an appropriate Pennit is displayed. Multiple citations may be issued for continual violation. 5 ---PAGE BREAK--- 4. PARKING: may park only in designated parking areas. Areas shown in black on the Parking map are reserved for parking; permits are not required for parking in these areas. accessing a regularly marked parking space must display a valid permit, or will be subject to citation, D. CLASSIFICATION OF PARKING AREAS The classification and/or the identifying number of each parking area are indicated on the accompanying map and on a sign at each parking area. A permit valid for the specific color is required for all private vehicles, except while parked at a meter. 1. GOLD: Gold permit required. Parking is prohibited between the hours of 2 a.m. and 6 a.m. in gold lots and all other areas posted as "NO OVERNIGHT PARKING". Parking Services may grant exceptions. 2. RED: Red or Gold permit required. No overnight parking allowed. Parking Services may grant exceptions. 3. BLUE: Blue, Red, Gold or Residential permit required. No permit is required to park in blue lots during summer and academic breaks. Overnight parking allowed at Lot 60 (located on Sweet Avenue) only. 4. SILVER: Silver Permit required. Overnight parking is allowed. These lots are for current residents of University Residence Halls, North Campus Center and Elmwood Apartments only. Permits are not transferable between University Residence Hall parking, North Campus Center and Elmwood Apartment parking. See E3 for additional information. 5. GREEN: Green Permit required. Overnight parking is allowed. Family Housing parking areas are provided for use by current residents of Family Housing. These permits are not transferable between Family Housing units and parking lots associated with each housing area. Visitor permits are required while visiting these areas, and is available only to students and their immediate family residing in those areas. 6. PURPLE: Purple Permit required. Overnight parking is allowed. Residential parking provided for those living in Greek Housing and Scholars 6 ---PAGE BREAK--- Residence located in the "old Greek" areas of campus (Elm, University, Idaho, etc.). 7. MAGENTA: Magenta Permit required. Overnight parking is allowed. Residential parking provided for those living in Greek Housing, Targhee, Steele, and Alumni Residence Center, located in the "new Greek" areas of campus (Nez Perce Drive, Blake Ave.). 8. TURNOVER LOTS: Parking provided for visitors, metered parking, and short-term parking. All permits allowed subject to specific lot/street/areas restrictions and guidelines. 9. RESTRICTED AREAS: a. Access/parking on the Campus Walkway system is restricted to vehicles displaying disabled permits and authorized exempt vehicles with authorized service or delivery permits. Individual vehicles are eligible for special access permits on a case-by-case basis. These permits are subject to time limitations. b. Lots 26 and 27 are controlled access areas and are thus closed to parking except to exempt vehicles and those with permits issued by the Parking office specifically for those lots. c. Certain lots may be closed preceding special events and regulated according to the needs of that special event. 10. METERED SPACES: General colored permits are not valid for parking in these spaces. Display of a Departmental Permit allows parking in a metered space. When a meter in a Gold, Red or Blue lot becomes nonfunctional and (or is) removed, that space reverts to a permit space. E. PARKING PERMITS Parking permits are sold on the web and at the Parking office. These permits correspond to color-coded parking areas as reflected in the accompanying map. The 2001-2002 permits are valid from date of purchase thru August 31, 2002. Please contact Parking Services for current pricing. GOLD: Permits sold to board appointed faculty and staff members only. An individual faculty or staff member may purchase only one gold permit. The Director of Auxiliary Services on a case-by-case basis may grant a waiver of 7 ---PAGE BREAK--- these restrictions. Any employee leaving a board appointed position is not eligible to continue to use a gold permit. Permits may be returned for a pro rated refund before April 30 of any particular academic year. Half-price gold permits are available to staff who work at night and receive a night-shift differential from the University. These permits are only valid between 12:00 p.m. and 6:00 p.m. SIT., VER: These permits are intended for current residents of the University Residence Halls North Campus Center and Elmwood Apartments only. If a student leaves the Residence Halls, North Campus Center or Elmwood Apartments, that student must turn in the permit and is eligible for refund/credit toward another permit Purchasing another permit in addition to or in lieu of a silver permit is permissible. Parking restrictions/rules for each individual permit will be applied (i.e. only Silver permits allowed in Silver areas). GREEN: These permits are for current residents of University Family Housing (Park Village, South Hill/South Hill Terrace Apartments) only. Permits are not valid in green areas other than your own apartment complex (Refer to D.4). Permits are required at all times. Visitors must display a valid visitor permit. If a student/family moves out of University Family Housing the green permit is no longer valid and must be turned in for refund or traded in for credit towards another permit (see refund schedule at Parking Services). Purchasing another permit in addition to or in lieu of a green permit is permissible. Parking restrictions/rules for each individual permit will be applied only Green permits allowed in Green areas). Those living in University Family Housing, on a space available basis, may purchase additional Family Housing permits. These second permits may be restricted to particular parking areas to increase the available parking close to the apartments. No second permits will be issued in the first three weeks of the fall semester. DISABLED PERSONS: Persons who are certified by a physician as mobility impaired, may request special short-term parking permits issued without charge, at Parking Services. These permits are honored in campus areas defined in regulation section State issued handicapped/disabled permits/license plates, will be honored in campus parking areas as described in regulation section 8 ---PAGE BREAK--- RETIRED UNIVERSITY EMPLOYEES: Retired University ofldaho employees are eligible for a complimentary permit. Permits allocated to retired University employees are intended for use only by the retiree and not by current UI employees or students. Such permits may not be sold, lent, or otherwise transferred. Retiree permits are valid in all Gold/Red/Blue parking areas. VENDOR PERMITS: Permits available to individuals and businesses that are not associated with the University. Proof of vendor employment business card) must be submitted, prior to purchase. The Parking Services office may grant exceptions to this regulation section. A vendor permit authorizes the vehicle to be parked in all permit lots and also serves as an access permit to the Campus Walkway System (subject to a 30 minute time limit). In general, parking is limited to two hours in any non-permitted area. Timed spaces limitations will be enforced against such permits. DEPARTMENTAL PERMIT: This permit allows a private vehicle some of the same access privileges as an exempt state vehicle, allowing short-term parking in all designated parking lots A regular permit must be purchased for daily parking on campus. Two hours in regular color-coded parking areas and meters for attending meetings away from your office. Departmental Permits are not valid in reserved spaces, disabled parking spaces, no parking zones or the on the campus walkway. Replacements and/or additional Departmental Permits must be purchased at full or prorated price. SELECT PERMITS (10 day): Address the needs of the occasional user of campus parking facilities. A photo ID is required of the purchaser and the permit cannot be transferred to another person. 10-day Red Permits are made available to anyone, while 10-day Gold Permits are restricted to Board Appointed faculty & staff. DA YCARE PERMIT: Permit category that covers all of the child education programs for temporary parking purposes only. This permit allows 15 minute parking in any lot to pick up or drop off a child. Vehicles must park legally in a regular space. D/C Permit does not allow for unpaid parking in a metered space. 9 ---PAGE BREAK--- VISITORS PERMIT: Refer to section of the regulations for permit information. MEDIA PERMIT: Permits issued to assist media personnel while on campus. Proof of media employment business card) must be submitted prior to permit being issued. They are not valid for U of I employees while working for the University. Media permits are valid in any permit space in any color-coded parking lot on campus and are also valid for up to two hours in meters and timed spaces. Media Permits are not valid on the campus walkway, in handicap spaces or for any form of illegal parking. PERMIT DISPLAY: A parking permit must be clearly visible and affixed as designed to the windshield, positioned on the inside, lower left- hand comer (driver's side) as viewed from the inside of the vehicle. All permits must be clearly readable from outside the vehicle. CAR POOLS: The University encourages the formation of car pools; two or more drivers can share in the purchase of a permit and rotate its use among their vehicles. The original purchaser may NOT transfer a permit to another person. The Palouse Clearwater Environmental Institute (PCEI) serves as a regional carpool information clearinghouse. For information, call them at 882-1444. REPLACEMENT PERMITS: Replacement permits for any individual purchased permit will be issued to the original permit holder for a $5.00 charge. If the identifiable remnants of the original are not turned in, the owner must sign a sworn affidavit for a lost, stolen, or canceled permit. PERMIT REVOCATION: A parking permit may be voided or revoked for the following reasons: -Termination of the permit holder's eligibility for the type of permit concerned. -Falsification of information in application for a parking permit or a replacement; -Continued violation of these regulations or nonpayment of penalties assessed; -Use of a counterfeit parking permit or alteration of a permit; or -Improper or fraudulent use of a permit. 10 ---PAGE BREAK--- WSU RECIPROCITY: The University of Idaho and Washington State University have developed a cooperative parking agreement for the purpose of enhancing the accessibility to either campus for faculty, staff and students participating in cooperative programs. UI permit holders should consult WSU Parking Services if questions arise (335-9684). All faculty, staff, students, or employees of other activities or agencies must display a permit from their respective university. This is determined by who issues your paycheck, or in the case of a student, university of enrollment. Parking regulations provide that any attempt to use a parking permit from a reciprocal university in lieu of a permit from your university of record may result in a fine. Selected parking permits from each university have been deemed valid in specific parking areas as outlined below. Short- term and select permits correspond to the color of lot for which they are issued. The following applies to UI permit holders who wish to park at WSU: 1. UI Gold, Department, and Retiree permits are valid in WSU Green, Yell ow, Red and Blue lots. 2. UI Red permits are valid in WSU Yellow, Red and Blue lots. 3. UI Blue permits are valid in the WSU Blue lots. 4. UI Visitor, Vendor, and Daycare permits are not valid at WSU. 5. No UI parking permits are valid in WSU Orange (parking structures), student resident gray lots, or housing lots. The following applies to WSU permit holders who wish to park at UI: 1. WSU Orange, Green, and Golden Cougar permits are valid in UI Gold, Red, and Blue lots. 2. WSU Yellow, Red, and Gray permits are valid in UI Red and Blue lots. 3. WSU Blue permits are valid in UI Blue lots only. 1 1 ---PAGE BREAK--- 4. WSU housing permits and visitor permits are not valid at the University of Idaho. 5. No WSU permits are valid in UI Silver, Purple, Magenta or Green residential lots. 18. LCSC RECIPROCITY: The University of Idaho and the Lewis Clark State College have developed a cooperative parking agreement for the purpose of enhancing the accessibility to either campus for faculty, staff and students participating in cooperative programs. UI permit holders should consult LCSC Security Department if questions arise ([PHONE REDACTED]). All faculty, staff, students, or employees of other activities or agencies must display a permit from their respective university. This is determined by who issues your paycheck, or in the case of a student, university of enrollment. Parking regulations provide that any attempt to use a parking permit from a reciprocal university in lieu of a permit from your university of record may result in a fine. F. For the purpose of these regulations, any motorized two-wheeled vehicle is considered to be a No motorized vehicles may be parked at bicycle racks. Permits are not required for parking in designated parking areas that are crosshatched in black on the map. However, parking in metered spaces does require payment. operators who wish to park in permitted vehicle spaces should consult with the Parking Services. Bicycles are to be parked in racks that are provided, or areas that do not impede the means of access to or egress from buildings, or congest or constrict emergency-access routes, driveways, loading docks or walkways. Prohibited parking locations for bicycles include, but are not limited to: stairways and stairwells, hallways, in building entrances and on access ramps for persons with disabilities. It is prohibited to chain or in some other manner to connect a bicycle to handrails, trees or shrubbery. All bicycles on campus must be licensed with the Moscow Police Department. or bicycles parked so that they constitute a safety problem, or that may potentially harm vegetation on campus, may be impounded without 12 ---PAGE BREAK--- warning. The University will not be responsible for damage to property incidental to the removal process. G. AUTHORITY/ENFORCEMENT AND PENALTIES 1. University Parking Services personnel have been empowered by the University of Idaho Board of Regents to issue citations for violations of these regulations, and to administer a Parking Services program. 2. All University, city and state traffic regulations and rules associated with the University of Idaho campus covering the operation and disposition of motor vehicles will be applied, including all civil and criminal procedures. Failure to comply may be cause for official action, including criminal prosecution and civil fines. 3. Non-University agencies, with jurisdictions that overlap that of the University; are also authorized to enforce appropriate local, state, and federal parking regulations independently. 4. Citations can be billed to the individual account of faculty, staff, and students when such billing information is available. Multiple tickets may cause a vehicle to be declared a nuisance and subject to wheel lock or impound (see Section G) 5. Parking Services assigns responsibility for outstanding tickets in the following manner: a) Driver of the vehicle, if known; b) Permit holder if a permit is displayed; or c) Registered owner per Department of Licensing. 6. MONETARY PENALTIES SCHEDULE Monetary penalties are established in the following amounts, and may be paid during regular University business hours at the Parking Services office, at any University cashier window, or by mail. Checks should be made payable to "UI Bursar": Fine schedule is attached to the back of the regulations. 7. IMMOBILIZATION AND IMPOUNDMENT 13 ---PAGE BREAK--- University Parking Services personnel may ticket, immobilize, impound or tow any nuisance vehicles from University of Idaho property. A. For purposes of the regulation, a nuisance vehicle is any vehicle: - with three or more unpaid parking tickets over 15 days old; - parked in a space reserved for persons with disabilities and not displaying a valid disabled access pennit; - obstructing traffic flow, parking in a fire Jane; - parked in a closed Jot, or appears abandoned or disabled; - not displaying a valid license plate or current vehicle license registration; or - driver/owner has provided false information or attempted fraud to the University B. Towed or immobilized vehicles may be reclaimed after-all outstanding monetary penalties related to the vehicle are paid. University of Idaho faculty, staff, and students may provide complete billing identification, including photo ID and a statement that the driver assumes responsibility for the vehicle. In certain instances, payment may be required "cash in full". The Parking Services office, on a case-by-case basis, will make decisions on the form of payment. C. If towing/impoundment has occurred, the Parking Committee will provide an opportunity for a post-tow hearing to detennine the validity of the tow. NOTIFICATION: When notification of the tow/impound has not been made to a responsible party within 48 hours, a written notice shall be sent by certified mail to the vehicles owner(s) or the applicable University parking pennit holder, and shall include the following information: - The name, address, and telephone number of the UI Parking Services office; - Vehicle description; - The authority and purpose of the impound; - A copy of these regulations; 14 ---PAGE BREAK--- - A statement of how the vehicle may be reclaimed; and - A statement of the right to a post-tow hearing. REQUESTING A HEARING: To receive a post-tow hearing, the vehicle's owner or permit holder must request a hearing in writing within ten (10) days of the date of the notice. Any such requested hearing shall be conducted at the next regularly scheduled meeting of the University Parking Committee. The Parking Committee's decision shall be final and binding on all parties. H. REVIEWS AND HEARINGS PARKING SERVICES REVIEW: Citations believed to have been issued in error can be reviewed by Parking Services if submitted thorough the parking web services or brought to the Parking Services office within 15 days of issue. Parking Services will not cancel tickets due to mitigating circumstances or disagreements with the regulations currently in effect. An independent University Parking Committee makes reviews of any such instances. REVIEW BY PARKING COMMITTEE: A request for review of a citation must be written on the official and received by the clerk in the Parking office within 15 calendar days of the date of issuance of the citation. The request must set forth the grounds on which the review or hearing is requested, and have attached any supporting documents or statements that you wish considered. The Parking Committee will only consider materials submitted at the time the appeal is filed. Late appeals must provide justification for the late submission. COMMITTEE ACTIONS: The Parking Committee acts by a majority vote. The Committee may decide to uphold the citation, dismiss it, or because of unique extenuating circumstances, reduce the monetary penalty below the amount normally assessed for the violation involved. NOTIFICATION: A person who files a written request for review will be notified of the Committee's decision as quickly as possible following the conclusion of the hearing. Delays may occur due to an excessive workload, lack of quorum, or similar circumstance. If a subsequent appeal overturns the citation, a credit will be issued at that time. 15 ---PAGE BREAK--- APPEALS: A citation upheld by the Parking Committee, may be appealed in person before the Committee. A request must be filed in the same manner as the written review request, within 15 calendar days of notification. Appointments must be made for such appeals. An appointment may be rescheduled up to three times, but failure to appear at the agreed upon time terminates the appeal process. The decision rendered by the Parking Committee following a written appeal AND an in-person appeal may then be appealed in writing to the Director of Auxiliary Services. DUE PROCESS REQUIREMENTS: No member of the Committee with any personal conflict of interest in a particular case will be allowed to participate in the determination of that case. The individual requesting a hearing has the right to testify, to present evidence and witnesses, to hear and question adverse witnesses, to rebut inferences that might be drawn from statements made against him or her, and to be assisted at the hearing by an adviser of his or her choice, and at his/her personal expense. The burden of proof rests upon the Parking Services, which will be allowed to call witnesses and submit oral/written evidence. The committee's decision will be based solely on matters indicated in the citation, stated in the request for review, or introduced into evidence at the hearing. I. VISITOR INFORMATION Visitors are always welcome on the University of Idaho campus. As a visitor, you are a guest of the University and those who pay for the University parking facilities. Visitors who wish to park in University lots must obtain visitor parking permits at the Information Center located in the North Campus Center, 645 W. Pullman Highway. Visitor permits are issued daily and are intended to serve the needs of those who are occasionally on campus. 16 ---PAGE BREAK--- Visitor permits are valid in all colored parking areas. Visitor permits are not valid at parking meters unless specifically noted, reserved spaces, handicap spaces, or on the Campus Walkway System. Vehicles displaying visitor permits are required to comply with University parking regulations as well as with city ordinances and state laws. Any citations received must be paid or appealed within 15 calendar days. The first citation issued for Permit violations may be waived for visitors if submitted thorough the parking web services or brought to the Parking office within 15 days. Subsequent tickets for same/similar violations must be paid or appealed. Members of the University of Idaho faculty, staff, student body, and regular users of University facilities are not eligible for visitor permits. J. DISABLED ACCESS The University of Idaho strives to maintain a campus easily accessible to those with disabilities. Vehicles displaying an authorized disability access permit or license plate, issued by the University, State/Local government, may park in any of the following areas: - any regular space in any lot; - streets within the campus walkway area; - spaces signed for "Handicap Parking Only"; - meters without paying the meters; or - Service and Delivery spaces. If you are mobility impaired, but do not use a wheelchair, please park in any available regular space before taking a handicap space. This helps maintain the oversized spaces for those with special needs, such as van lifts and wheelchair users. Vehicles displaying authorized handicap permits/plates may NOT park illegally, in NO PARKING zones, outside of designated spaces, within FIRE LANES, or in spaces reserved for another person or user.
