ORDINANCE NO. 86-29 355860 AN ORDINANCE OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF IDAHO, PROVIDING FOR THE ANNEXATION AND ZONING OF CERTAIN LANDS DESCRIBED IN SECTION 2 OF THIS ORDINANCE; PROVIDING THAT LANDS DESCRIBED IN SECTION 2 OF THIS ORDI NANCE BE HEREAFTER ZONED 11RS-111 (SINGLE FAMILY RESIDENCE DISTRICT - PROVIDING THAT THE OFFICIAL ZONE MAP OF THE CITY OF MOSCOW BE AMENDED ACCORDINGLY; PROVI DING FOR THE REPEAL OF ANY MOSCOW CITY CODE SECTION IN CONFLICT WITH THIS ORDINANCE; PROVIDING FOR THE EFFECTIVE DATE AND PUBLICATION OF THIS ORDINANCE. WHEREAS, the lands described in Section 2 of this ordinance are lying adjacent to the City of Moscow, Idaho; and, WHEREAS, said 1 and is intended and can reasonably be assumed to be used for the orderly development of the City of Moscow, Idaho; and WHEREAS, the owner of a portion of said land has requested in writing of the City Council of the City of Moscow, I daho, that said land be annexed to the City of Moscow, Idaho; and, WHEREAS, other portions of said lands have been laid off into blocks containing not more than five acres of land each; and, WHEREAS, public hearings have been held, pursuant to Idaho Code, on the annexation and zoning of said parcels; NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MOSCOW, IDAHO AS FOLLOWS: SECTION 1: ANNEXATION: That the lands described in Section 2 of this ordinance be and the same hereby are annexed to the City and declared a part of the City of Moscow. SECTION 2: LEGAL DESCRIPTION: That the annexation of land, and the rezoning of land described in this ordinance shall apply to the following described areas of land situated in Latah County, Idaho, and more particularly described as follows, to wit: A tract of land located in the South Half (S 1/2) of Section Sixteen (16), Township Thirty-Nine (39) North, Range Five West, Boise Meridian, Latah County, I daho, more particularly described as fallows: Beginning at the Northeast corner of Lot Thirty-six (36) of said Section Sixteen (16) as shown on recorded plat of the subdivision of said Section Sixteen (16) said point being THE TRUE POINT OF BEGIN NING; thence North along the projected East line of said Lot Thirty Six (36) 40.00 feet to the centerline of a vacated 80 foot right of-way; thence West along said vacated right-of-way centerline 660.00 feet to the intersection with the centerline of a vacated 80 foot right-of-way running north and south; thence South along said vacated right-of-way centerline 350.00 feet; thence West 280.00 feet to the ---PAGE BREAK--- . ' . . 355860 Northeast corner of the Moscow Cemetery property, said point being on the Easterly most line of said cemetery property, being the existing city limit line; thence South along said city limit line 812.21 feet, more or less to the intersection with the Northerly right-of-way line of State Highway 8; thence Easterly along said State Highway right of-way line along a curve to the left 608.67 feet more or less to the West line of the Cann tract, said curve having a radius of 3780.00 feet and a central angle of 9° 13' 33"; thence north along said west 1 i ne 283.32 feet to the Northwest corner of said Cann tract; thence East along the North line of said Cann tract 225.37 feet to the intersection with the West line of the Mullalley tract; thence North along said West line 5.00 feet to the Northwest corner of said Mullalley tract; thence East along the north line of said Mullalley tract 115.00 feet to the East line of Lot Forty-five (45) of said Section Sixteen (16); thence North along said East line 112.79 feet more or less to the Southeast corner of said Lot Thirty-six (36); thence North along said Lot Thirty-six (36); 620.00 feet to the TRUE POINT OF BEGINNING. Said tract contains 19 acres, more or less. SECTION 3: ZONING: That the lands described in Section 2 of this ordinance be and the same hereby are zoned "RS-1" (Single Family Residence District - 1) and the City Engineer is hereby directed to make the necessary amendments to the Official Zoning Map of the City of Moscow, which map is on file at the City Hall. SECTION 4: Any Moscow City Code section in conflict with the provisions of this ordinance, insofar as said section in any way conflicts with this ordinance, is hereby repealed. SECTION 5: Provisions of this ordinance shall be deemed severable and the invalidity of any provisions of this ordinance shall not affect the validity of any other provisions. SECTION 6: This ordinance shall be in full force and effect from and after the date of its passage, approval and first publication according to law.
