ORDINANCE NO. 89-13 AN ORDINANCE OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF IDAHO; PROVIDING THAT LANDS DESCRIBED IN SECTION 1 OF THIS ORDINANCE BE ANNEXED TO THE CITY OF MOSCOW; PROVIDING THAT LANDS DESCRIBED IN SECTION 1 OF THIS ORDINANCE BE ZONED AS FOLLOWS: PARCEL 1 - SR, PARCEL 2 - FR; PROVIDING THAT THE PROVISIONS OF THIS ORDINANCE BE DEEMED SEVERABLE; PROVIDING FOR THIS ORDINANCE TO BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, APPROVAL AND PUBLICATION ACCORDING TO LAW. WHEREAS, it is desirable that the development of land in the proximity of the City of Moscow occur within the city limits, where practical, in order that the developed land may be provided city services including public water and sewer; NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL AS FOLLOWS: SECTION 1: Description: This ordinance shall apply to the following described parcels of land located in Moscow, Latah County, Idaho, to wit: Parcel No. 1: A tract of land located in the northeast quarter of Section 5, Township 39 North, Range 5 West, Boise Meridian, Latah county, Idaho, more particularly described as follows: Beginning at the northwest corner of the northeast quarter of the northeast quarter of said section 5; thence easterly, along the north line of said Section 5, 662.44 feet; thence southerly, along the west line of the Floyd Trail tract, to the point of intersection with the south right-of-way line of Trail Road; thence southwesterly along said right-of-way line to a point, said point being 730 feet north of the south line of the northeast quarter of said Section 5, thence westerly, parallel to said south line, to the point of intersection with the west right-of-way line of Orchard Avenue; thence northerly, along said right­ of-way line, to the point of intersection with the north line of said Section 5; thence easterly, along said north line, to the point of beginning. Parcel No. 2: A tract of land located in the east half of Section 5, Township 39 North, Range 5 West, Boise Meridian, Latah County, Idaho, more particularly described as follows: Beginning at the northeast corner of the southwest quarter of the southeast quarter of said Section 5; thence westerly along the north line of said southwest quarter of the southeast quarter 232 feet to the southwest corner of the Irene Johnson ---PAGE BREAK--- tract; thence northerly and easterly along the westerly boundary of said tract to the point of intersection with the westerly boundary of the Wayne and Betty Susa tract; thence northerly and westerly along said westerly boundary of the Suza tract to the northwest corner of said tract; thence southeasterly along the north boundary of said tract to the point of intersection with the westerly right-of-way line of Orchard Avenue; thence northerly along said right-of­ way line to a point, said point being 730 feet north of the north line of said southeast quarter of Section 5; thence easterly, parallel to said north line, to the point of intersection with the easterly right-of-way line of Trail Road; thence southerly along said right­ of-way line to the northeast corner of the Kenneth Hedglin tract; thence southerly and southeasterly along the west line of the Floyd Trail tract to the point of intersection with the north line of the John Maurin tract; thence easterly along said north line to the point of intersection with the east line of said Section 5; thence southerly along said east line 165 feet to the southeast corner of said Maurin tract; thence westerly along the south line of said Maurin tract to the point of intersection with the east line of the southwest quarter of the southeast quarter of said Section 5, thence northerly along said east line to the point of beginning. SECTION 2: ANNElXATION: That the lands described in Section 1 of this ordinance be and the same hereby are annexed to the City and declared a part of the City of Moscow. SECTION 3: ZONING: That the lands described in Section 1 of this ordinance be, and the same are hereby zoned as follows: Parcel No. 1: "SR" (Suburban Residential District). Parcel No. 2: "FR" (Farm, Ranch, Outdoor Recreation District) . The City Engineer is hereby directed to make the necessary amendments to the Official zoning Map which is on file at City Hall. SECTION 4: SEVERABILITY: The provisions of this ordinance shall be deemed severable and the invalidity of any provision of this ordinance shall not affect the validity of any remaining provision. SECTION 5: EFFECTIVE DATE: This ordinance shall be effective upon its passage, approval and publication according to law. Ord.
