521545 PERMANENT PUBLIC UTILITY EASEMENT MOSCOW MAIN, L.L.C., a Washington Limited Liability Company, whose current address is 845 106TH Avenue NE, Suite 100, Bellevue, Washington 98004, GRANTORS, owners of real property affected hereby, in consideration of one dollar and other valuable consideration in hand paid, does hereby grant the CITY OF MOSCOW, a municipal corporation of the State of Idaho, 206 East Third Street, Moscow, Idaho 83843, GRANTEE, and its agents and assigns, non-exclusive permanent easements and rights of-way in which to construct and maintain public utilities including the right to enter upon, occupy and use property located in the City of Moscow, Latah County, Idaho, to wit: A 20.00 foot wide public utility easement situated in Block 1 of the Re-Piat of Moore's Addition to the City of Moscow, Idaho, recorded in Book 3 of Plats, page 29, records of said Latah County, with said easement shown on the attached 'Exhibit A' and being more particularly described as 10 feet each side of the following described centerline: Commencing at the northwest corner of said Block 1; thence S89°09'10"E 135.00 feet along the north boundary of said Block 1; thence S00°57'50"W 80.00 feet along the centerline of a vacated alley, to the TRUE POINT OF BEGINNING; thence continuing S00°57'50"W 1.75 feet along said centerline; thence leaving said centerline, S54°45'48"E 92.48 feet to a point hereinafter referred to as "Point thence continuing S54°45'48"E 23.97 feet; thence S00°02'28"W 120.00 feet; thence S45°1 0'25'W 73.38 feet to the north right-of-way line of Street and the terminus of this centerline description. The sidelines of said easement shall be extended and shortened to ensure the full width of the easement begins at the northerly boundary of the Moscow Main, L.L.C. tract and ends at its southerly boundary being the north right-of-way line of Street. Said easement contains 6,232 square feet, more or less. Together with a 15.00 foot wide public utility easement also situated in Block 1 of the Re Piat of Moore's Addition to the City of Moscow, Idaho, recorded in Book 3 of Plats, page 29, records of said Latah County, with said easement shown on the attached 'Exhibit A' and being more particularly described as 7.5 feet each side of the following described centerline: Beginning at the aforementioned "Point A" of the above described easement centerline; thence N01 °00'46"E 39.42 feet to the terminus of this centerline description. The sidelines of said easement shall be begin at the northeasterly boundary of the above described easement. Said easement contains 410 square feet, more or less. for the purpose of constructing, operating, maintaining, and repairing or replacing said public utilities by the City of Moscow or its agents or contractors or franchised utility companies. GRANTORS, their successors and assigns, reserve the right to improve said easement area as long as such improvement shall not unreasonably interfere with the construction, operation, maintenance, repair and/or reconstruction of the public utilities. GRANTORS agree that they and their heirs or assigns will not build or place any new encroachment thereon which will unreasonably interfere with the right of the GRANTEE. PERMANENT PUBLIC UTILITY EASEMENT Page 1 of2 2008-ll ---PAGE BREAK--- 521545 The GRANTEE, its agents or transferees, shall have the right to perform any maintenance it may deem necessary or wish to exercise in connection with the aforesaid public utilities (including, but not limited thereto, the right to make necessary repairs, alterations, and removals or replacement thereof). Upon exercising these rights, GRANTEE shall restore the property to its prior condition. GRANTEE is granted the aforementioned rights, together with the rights and privileges of ingress and egress to and from said property for the above stated purposes. It is expressly intended that the rights, burdens and restrictions contained in this Easement shall run with the land and shall forever bind GRANTORS AND GRANTEE, their heirs and assigns.
