RELEASE OF LIABILITY, HOLD HARMLESS AND INDEMNITY AGREEMENT AND AGREEMENT TO EUTHANIZE DOG WHEREAS, City of Moscow, Idaho ("City'') recognizes that some animals pose a threat to the health and welfare of citizens; and WHEREAS, City and Owner have determined that euthanasia of a German Shepherd dog named Kato, owned by Gregory J. Harmon is an appropriate and humane resolution of a situation which recently occurred in Moscow; and WHEREAS, City assumes no risk nor liability for animals euthanized; and WHEREAS, Owner expressly intends that City is not liable for any action or inaction of Owner or City related to the euthanasia of the animal identified herein; and WHEREAS, Owner expressly intends to release City of any liability, intends to hold City harmless from liability, and intends to indemnify City for any liability arising out of the euthanasia of the animal herein identified; and WHEREAS, Owner has had the opportunity to seek legal and other counsel regarding this Release of Liability, Hold Harmless and Indemnity Agreement and Agreement to Euthanize Dog prior to signing it; and WHEREAS, Owner understands each and every provision of this Release of Liability, Hold Harmless and Indemnity Agreement and Agreement to Euthanize Dog, voluntarily wishes to enter into it, and agrees to abide by its terms and conditions; THEREFOR, FOR AND IN CONSIDERATION of City euthanizing Owner's German Shepherd dog Kato, the receipt and sufficiency of which is hereby acknowledged, I, Gregory J. Harmon, 1431 Alpowa, Moscow, Idaho, 83843 do hereby release, acquit, and forever discharge City of Moscow, Idaho, the Moscow Police Department, and its agents, servants, employees, officers, directors and attorneys whether named herein or not, all and each of them, of and from any and all actions, causes of actions, claims and demands, damages, costs, loss of services, expenses and compensation on account of or in any way growing out of, and I do hereby agree to indemnify and hold harmless said City of Moscow, Idaho, Moscow Police Department, and its agents, servants, employees, officers, directors and attorneys whether named herein or not, all and each of them, of and from all further claims and demands, any and all actions or causes of action, costs or expenses arising out of such euthanasia.
