ORDINANCE NO. 2001-23 AN ORDINANCE OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, PROVIDING THAT LANDS DESCRIBED IN SECTION 1 OF THIS ORDINANCE AND SHOWN ON EXHIBIT HERETO BE ANNEXED TO THE CITY OF MOSCOW; PROVIDING THAT THE PROVISIONS OF THIS ORDINANCE BE DEEMED SEVERABLE; PROVIDING FOR THIS ORDINANCE TO BE IN FULL FORCE AND EFFECT FROM AND AFTER PASSAGE, APPROVAL AND PUBLICATION ACCORDING TO LAW. WHEREAS, the Moscow Mayor and City Council adopted Resolution 2001-15 which established annexation standards and guidelines creating an annexation policy; and WHEREAS, lands described in Section I of this Ordinance and shown on Exhibit hereto are adjacent to and surrounded by the City of Moscow, Idaho; and WHEREAS, Idaho Code Section 50-222 authorizes city annexation of tracts of! and adjacent to and surrounded by the City; and WHEREAS, the Moscow Mayor and City Council held a public meeting regarding this matter on July 2, 2001; and WHEREAS, the Moscow Mayor and City Council held a public meeting regarding this matter on December 3, 2001; and WHEREAS, the Moscow Mayor and City have determined that annexation of lands described in Section 1 of this Ordinance and shown on Exhibit hereto as Parcel 1 is appropriate and is consistent with Council policy established in Resolution 2001-15; and NOW THEREFORE, be it ordained by the Mayor and Council of the City of Moscow as follows: SECTION 1: LEGAL DESCRIPTION: This Ordinance shall apply to the following described lands in Moscow, Latah County, Idaho, to-wit: Parcell A tract of land located in the south half of Section 5 and the north half of Section 8, Township 39 North, Range 5 West, Boise Meridian, Latah County, Idaho and more particularly described as follows: Beginning at the northwest comer of the northeast quarter of said Section 8; thence S00°37'22"W 833.04 feet along the west line of said northeast quarter to a point on the southerly right-of-way line of Public Avenue and the northeast comer of Bowers Second Addition to the City of Moscow, Latah County, Idaho as shown on the plat recorded in Book 5 of Plats, page 35 on file in the recorder's office of Latah County; thence S42°55'3l"W 163.39 feet along said southerly right-of-way line and the northerly boundary of said Bowers Second Addition; thence continuing along said southerly right-of-way line and northerly boundary of said Bowers Second Addition S66°59'3 I "W 409.47 feet to the ---PAGE BREAK--- northeast comer of Lot 50 of the Replat of Homestead Addition to the City of Moscow, Latah County, Idaho as shown on the plat recorded in Book 3 of Plats, page 28 on file in the recorder's office of said county; thence N00°59'31 "E 65.68 feet to the southeast comer of Lot 51 of said Replat of Homestead Addition, said point being on the westerly right-of-way line of Howard Street as shown on said plat; thence continuing N00°59'31"E 281.10 feet along said right-of-way line to the northeast comer of Lot 52 of said Replat of Homestead Addition; thence N89°05'29"W 290.00 feet to the northwest comer of said Lot 52 and a point on the east right-of-way line of Polk Street; thence N00°59'31"E 776.90 feet along said east right-of-way line to the north line of the northwest quarter of said Section 8; thence S88°50'54"E 11.30 feet along said north line and along the southerly boundary of the Peterson-Williams Subdivision, Latah County, Idaho as shown on the plat recorded in Book 6 of Plats, page 99 on file with the recorder's office of said county; thence N07°56'31 "W 20.25 feet along the westerly right-of-way line of Polk Street extended to the southwest comer of Lot 3 of said Peterson-Williams Subdivision; thence following the boundary of said Lot 3 as follows: S88°50'54"E 436.59 feet; N00°29'37"E 673.11 feet; S90°00'00"E 323.00 feet; N00°29'37"E 588.94 feet; N89°15'li"W 280.00 feet; and S00°29'37"W 205.00 feet to the northeast comer of Lot 2 of said Peterson - Williams Subdivision; thence N89°15'l l "W 605.17 feet along the north boundary of said Lot 2 to the southeast comer of a parcel of land annexed by the City of Moscow, Latah County, Idaho in Ordinance No.98- IO; thence N00°29'37"E 205.00 feet along the east boundary of said parcel to a point on the north boundary of Lot 1 of said Peterson Williams Subdivision; thence N89°15'li"W 123.08 feet to the northwest comer of said Lot 1; thence N06°25'13"W 19.15 feet along the easterly right-of-way line of Polk Street to the northerly boundary of said Peterson-Williams Subdivision; thence N89°15'11 "W 15.10 feet along said boundary to a point on the easterly right-of-way line of Polk Street; thence northerly 21.10 feet along a curve concave to the east, said curve having a radius of 261.48 feet, a central angle of 04°37'28", and a chord bearing N04°47'51"W 21.10 feet to the south boundary of the Schutz tract described in Warranty Deed No.285761 on file with the recorder's office of said county; thence S89°15'l l "E 712.60 feet along said south boundary; thence N00°29'37"E 631.65 feet to a point on the north boundary of said Schutz tract; thence S89°27'23"E 315.00 feet along said north boundary to a point on the west line of the southeast quarter of Section 5, Township 39 North, Range 5 West, Boise Meridian; thence S00°29'37"W 249.24 feet along said west line to the southwest comer of a parcel of land annexed by the City of Moscow, Latah County, Idaho in Ordinance No.99-06; thence S89°48'57"E 549.51 feet along the boundary of said parcel; thence S00°29'37"W 396.00 feet along said boundary to the northeast comer of the Grand-View Addition to the City of Moscow, Latah County, Idaho, as shown on the plat recorded in Book 4 of Plats, page 40 on file with the recorder's office of said county; thence continuing S00°29'37"W 656.00 feet along the west boundary of said addition to the northwest comer of the Orchard Place Addition to the City of Moscow, Latah County, Idaho, as shown on the plat recorded in Book 4 of Plats, page 42 on file with the recorder's office of said county; thence continuing S00°29'37"W 660.00 feet to the southwest corner of said addition; thence S89°49'23"E 200.50 feet along the south boundary of said addition to the northwest comer of a parcel of land described in Deed No.391549 on file with said recorder's office; thence S00°22'00"E 742.50 feet along the west boundary of said parcel to the north right-of-way line of Public Avenue; thence N89°49'23"W 300.00 feet along said north right-of-way line to the east boundary of a parcel of land annexed by the City of ---PAGE BREAK--- Moscow, Latah County, Idaho in Ordinance No. l418; thence N00°22'00"W 742.50 feet along said east boundary to the north line of the northeast quarter of said Section 8; thence N89°49'23"W 450.00 feet along said north line to the northwest corner of said northeast quarter and the point of beginning. SECTION 2: ANNEXATION: The lands described in Section 1 of this Ordinance and shown on Exhibit hereto as Parcel 1 be and the same hereby are, annexed to the City of Moscow, Idaho and declared a part of the City of Moscow, Idaho; and the Moscow City Engineer is hereby ordered to make the necessary amendments to the official City limits map, zoning map, and Area of City Impact map for the City of Moscow, Idaho, which are on file at City Hall. SECTION 3: SEVERABILITY: Provisions of this Ordinance including every exhibit subpart of Section I of this Ordinance, shall be deemed severable and the invalidity of any provision of this Ordinance including any exhibit subpart of Section 1 of this Ordinance, shall not affect the validity of remaining provisions or subparts. SECTION 4: EFFECTIVE DATE: This Ordinance shall be effective upon its passage, approval and publication according to law.
