SETTLEMENT AGREEMENT AND GENERAL RELEASE OF CLAIM JAMES G. ALLEN KNOW ALL PERSONS BY THESE PRESENTS: James G. Allen (hereinafter "Allen"), in consideration of the City of Moscow, Idaho (hereinafter referred to as "City") paying to Allen two hundred thirty three and fifteen one hundredths dollars ($233.15) for damages to a cellular telephone (Motorola Razor Model No. V3M) used in the course and scope of Allen's employment, Allen does hereby release, acquit and forever discharge the City and their successors, assigns, agents, servants, employees and insurers, and all persons acting for, by or through or in any way in behalf of said City of Moscow, Idaho, of and from all claims of every kind, actions, causes of action, judgments, damages, liabilities and demands of whatsoever kind, name or nature, known or unknown, contingent or mature, in any way having to do with, arising, having misen, to arise, or which may arise out of or by reason of the events of the said cell phone damage. This Settlement Agreement and Release is made and entered into as the free and voluntary act of Allen, in the exercise of his infonned judgment, belief and knowledge of the nature, extent, and duration of Allen's claims and damages, known or unknown, and is not made or entered into under the influence of the City or any attorney, representative, agent, or other person acting for, through, or on behalf of City, and that said City has not induced or influenced the undersigned to make this settlement or execute this release.
