AGREEMENT FOR USE OF REAL PROPERTY THIS AGREEMENT is made and entered into this '-J4i- day of !1Cl111Juv , 1995, by and between Philip Abbott, of 39620 Griggs Drive, Lebanon, Oregon 97355 (hereinafter the "Owner"), and the City of Moscow, a municipal corporation of the State of Idaho (hereinafter the "City"): WHEREAS, the Owner is the owner of the real property commonly known as 443 Lewis Street, Moscow, Latah County, Idaho; and WHEREAS, said real property was the site of a homicide; and WHEREAS, the City has requested continuing access and availability of 443 Lewis Street, Apartment No. 2, as part of the on-going criminal investigation of such homicide; NOW, THEREFORE, in consideration of the following covenants, the parties agree as follows: W I T N E S S E T H: I. The City agrees to pay the Owner the amount of One Thousand Dollars ($1,000.00) for the continued access to and availability of 443 Lewis Street, Apartment No.2, for the period of June 5, 1995 through December 31, 1995. 2. The Owner hereby grants a general release, for himself, his heirs, executors, administrators and assigns, and to waive, remise and forever discharge and release the City and any and all elected or appointed officials of the City, and all officers, employees, volunteers, agents, insurers and any other individuals or entities affiliated with such persons and/or entities from any and all claims, several or otherwise, past, present or future, which can or may ever be asserted as a result of any injuries, damages or expenses incurred by the Owner due to the City's use, custody, and control of 443 Lewis Street, Apartment No.2.
