ORDINANCE NO. _l:.oo o.e _ AN aiDINANCE VACATING A PORTION OF THE ALLEY IN BLOCK SIX OF H. S ADDITION TO THE CITY OF MJSOOW, LYING AND BEING BEfWEEN THE SOOTH LINE OF SEVENTH SfREEf IN SAID CITY AND THE OOUTH LINES OF LOI'S FOOR AND NINE OF SAID BLOCK SIX IN THE CITY OF MJSOOW, OOUNTY OF LATAH, STATE OF IDAHO; AND SUBJECT TO CeRTAIN CONDITIONS THEREIN; AND PROVIDING THAT THE ALLEY SO VACATED SHALL REVffiT TO THE MOSOOW OOSPITAL ASSOCIATION, A NON-PRDFIT CORPORATION, ITS SUCCESSORS AND ASSIGNS, IN THE MANNER PROVIDED BY Sa:::riON 50-1124 OF THE IDAHO OODE; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAIN:s:> BY THE MAYOR AND COUNCIL OF THE CITY OF K)&;OW, IDAHO: Section 1. Tna& portion of the alley in Block Six of H. McGregor's Addition to the City of Moscow, lying and being between the South line of Seventh (7th) Street in said City and the South lines of Lots Four and Nine of said Block Six in the City of Moscow, County of Latah, State of Iclaho, the area being vacated being more particularly described as follows, to wit: Beginning at the Northwest corner of Lot Twelve (12) of Block Six of H. McGregor's Addition to the City of Moscow, as shown by the recorded plat thereof, and running thence South a distance of two hundred feet (200') to the Southwest corner of Lot Nine of said Block Six thence West a distance of twenty (20) feet to the Southeast corner of Lot Four of said Block Six thence North a distance of two hundred (200) feet to the Northeast corner of Lot One of said Block Six thence East a distance of twenty (20} feet to the point of beginning; be, and the same is, hereby vacated. This vacation is conditioned upon the Moscow Hospital Association, their successors or others occupying said vacated portion of the area, maintaining and protecting the sanitary sewer line now located in said vacated portion of the area in such manner as may be specified by the City of Moscow; subject, further, to the condition that the City of Moscow in no manner be held responsible for the maintenance or relocation for the public utilities now located in said vacated part of the area. That these conditions have been agreed to and accepted by the Moscow Hospital Association. Section 2. That the area so vacated shall revert to the Moscow Hospital Association, a non-profit corporation, its successors and assigns, as provided by Section 50-1124 of the Idaho Code. Section 3. This ordinance shall be in full force and effect from and after the date of its passage, approval and publication.
