ORDINANCE NO. 87-10 AN ORDINANCE OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF IDAHO, PROVIDING FOR THE VACATING OF THE WEST TEN ( 10) FEET OF THE HARRISON STREET RIGHT-OF-WAY BETWEEN 6TH AND 8TH STREETS WITHIN THE CITY OF MOSCOW; PROVIDING THAT TITLE TO SAID VACATED RIGHT-OF-WAY SHALL VEST WITH THE OWNERS OF THE PROPERTIES DIRECTLY WEST OF THE DESCRIBED PROPERTIES; PROVIDING THAT THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, APPROVAL AND PUBLICATION ACCORDING TO LAW. WHEREAS, Kelly and Judy Harkins, and Dennis and Lori Mulalley have petitioned for the vacating of a portion of the Harrison Street right-of-way; and WHEREAS, on the 21st day of September, 1987, the City Council conducted a public hearing on the matter of vacating a portion of the Harrison Street right-of-way and determined that vacating a portion of the right-of-way requested was in the public interest; NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MOSCOW AS FOLLOWS: SECTION 1: That the following described street right-of-way be, and the same hereby is vacated as of the effective date of this ordinance: Tracts of land located in the Northwest Corner of Section 17, Township 39 North, Range 5 West, Boise Meridian, Latah County, Idaho, more particularly described as follows: Tract No. 1: Beginning at the Northeast Corner of Block 1 of McGregor's Second Addition to the City of Moscow; thence Southerly along the Westerly right-of-way line of Harrison Street 142 feet to the point of intersection with the Northerly right-of-way line of a dedicated alley; thence Easterly and parallel to said Northerly alley right-of-way line 10 feet; thence Northerly and parallel to said Westerly street right-of-way line 142 feet to a point on the Southerly right-of-way line of Sixth Street; thence Westerly along said Southerly street right-of-way 10 feet to the point of beginning. Tract No. 2: Beginning at the Southeast Corner of Block 1 of McGregor's second Addition to the City of Moscow; thence Northerly ---PAGE BREAK--- along the Westerly right-of-way line of Harrison Street 142 feet to the point of intersection with the Southerly right-of\way line of a dedicated alley; thence Easterly and parallel to said Southerly alley right-of-way line 10 feet; thence Southerly and parallel to said Westerly street right-of-way line 142 feet to a point on the Northerly right-of-way line of Seventh Street; thence Westerly along said Northerly street right-of-way 10 feet to the point of beginning. Tract No. 3: Beginning at the Northeast Corner of Block 4 of McGregor's Second Addition to the City of Moscow; thence Southerly along the Westerly right-of-way line of Harrison Street 140 feet to the point of intersection with the Northerly right-of-way line of a dedicated alley; thence Easterly and parallel to said Northerly alley right-of-way line 10 feet; thence Northerly and parallel to said Westerly street right-of-way line 140 feet to a point on the Southerly right-of-way line of Seventh Street; thence Westerly along said Southerly street right-of-way 10 feet to the point of beginning. Tract No. 4: Beginning at the Southeast Corner of Block 4 of McGregor's Second Addition to the City of Moscow; thence Northerly along the Westerly right-of-way line of Harrison Street 140 feet to the point of intersection with the Southerly right-of-way line of a dedicated alley; thence Easterly and parallel to said Southerly alley right-of-way line 10 feet; thence Southerly and parallel to said Westerly street right-of-way line 140 feet to a point on the Northerly right-of-way line of Eighth Street; thence Westerly along said Northerly street right-of-way 10 feet to the point of beginning. SECTION 2: That ownership in the above described parcels of land be and the same hereby is granted to the owners of the properties located directly west of the above described property. SECTION 3: That the City of Moscow retains utility easements necessary for the maintenance of any existing utilities located within the aforementioned property and specifically retains the right to enter this property to service such utilities. No person shall construct any building within ten feet of an existing water or sewer line without first obtaining written approval from the City. ---PAGE BREAK--- SECTION 4: This ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
