AMENDMENT TO AGREEMENT BETWEEN CITY OF MOSCOW, IDAHO AND SOUTHEAST MOSCOW WATER AND SEWER DISTRICT THIS AMENDMENT TO THE AGREEMENT MADE BETWEEN CITY OF MOSCOW, IDAHO (hereinafter "CITY") AND SOUTHEAST MOSCOW WATER AND SEWER DISTRICT (hereinafter "DISTRICT") is for the purpose of extending the current Agreement to a term ending September 30, 2013 (rather than on its current expiration date of December 1, 2012). WHEREAS, CITY wishes to continue to provide to DISTRICT the services contained within the Agreement between CITY and DISTRICT entered into the 3rd day of June, 1991; and WHEREAS, DISTRICT wishes that the services provided by CITY continue under the same terms and conditions as the Agreement between the parties dated the 3rd day of June, 1991; NOW, THEREFORE, in consideration of the covenants and agreements set forth in the Agreement between the parties entered into the 3rd day of June, 1991, it is mutually agreed as follows: Agreement To Extend Agreement Termination Date. , Pursuant to Section Ill, paragraph 7 of the Agreement between the parties dated the 3rd day of June, 1991, the parties hereby agree that the term of such Agreement shall not terminate on December 1, 2012 but shall continue under the same terms, conditions; covenants, and agreements as the original Agreement entered into by the parties on the 3rd day of June, 1991 until September 30, 2013.
