RESOLUTION NO. 2001- 23 A RESOLUTION OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, ESTABLISHING AND REFORMING PARKING FINE COLLECTION PROCEDURES AND PROCESSES, PROVIDING THIS RESOLUTION TO BE EFFECTIVE UPON ITS PASSAGE AND APPROVAL. WHEREAS, consistency is desired in the collection of parking fines; and WHEREAS, City Council is interested in eliminating the burden on the courts and any possible public inconvenience concerning payment of parking citations; and WHEREAS, City Council is concerned with compliance and fairness in the parking fine collection system; and WHEREAS, City Council passed Resolution 2000-16 because it would make payment and enforcement of parking citations more likely; and WHEREAS, City Council believes that amendment of Resolution No. 2000-16 is in the best interest of the City and would promote efficiency in parking enforcement. NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Moscow as follows: PROCEDURE l. Any person receiving a parking citation pursuant to the Moscow City Code shall have fifteen (15) days from the date of issuance of such citation to pay all fmes related to such citation to the City. 2. Any person who fails to pay a parking citation within fifteen ( 15) days shall be assessed a ten dollar 0) administrative fee in addition to the fine assessed for the underlying parking violation as such fee has been established by Council Resolution. 3. Any person who fails to pay their parking citation within eighteen ( 18) days from its issuance may be sent a "Summons and Complaint Letter" advising such person of the amount due at that time and that the citation will be sent to traffic court if not paid within thirty-one (31) days from the issuance of the citation. 4. Any person who fails to pay their parking citation within twenty-five (25) days from its issuance may be personally served with a "Summons and Complaint" notifying such person of referral of the matter to traffic court. If such person still does not pay within five additional days following receipt of the "Summons and Complaint" (or thirty-one (31) days from the issuance of the citation), the citation may be immediately referred to traffic court. Service of the "Summons and Complaint" may be performed by the City Parking Enforcement Supervisor or other City designee. 5. Any person who fails to appear at any traffic court proceeding may be referred to the Department of Transportation for driver's license suspension until such time as the relevant matter of dispute is resolved. 6. Any person who has been issued three or more parking citations which have not been resolved within the fifteen ( 15) days allowed shall have a motor vehicle immobilization unit (such as a vehicle RESOLUTION- PARKING 2001 Page 1 of2 ---PAGE BREAK--- boot, wheel locking mechanism, or the like) placed on their vehicle. Any person who has been issued four or more parking citations which have not been resolved within the fifteen (15) days allowed shall be towed. Any person whose vehicle has been immobilized and who does not pay the immobilization unit removal fee and all outstanding parking fmes and costs within twenty-four (24) hours of such immobilization shall have the vehicle towed. 7. Every person shall pay for all costs associated with impoundment and/or removal if towing occurs. Costs associated with placing an immobilization unit on a vehicle shall include a fifty dollar ($50) removal fee. Release of impoundment of the vehicle or removal of a immobilization unit from a vehicle shall not occur until payment in satisfaction of all outstanding parking citations has been made in full.
