i r fJl!tf!Q PETERSEN ORDINANCE NO. 2005-17 AN ORDINANCE OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, PROVIDING THAT LAND DESCRIBED IN SECTION 1 OF THIS ORDINANCE AND GENERALLY SHOWN ON EXHIBIT ATTACHED HERETO AND INCORPORATED BY THIS REFERENCE BE ANNEXED TO THE CITY OF MOSCOW; PROVIDING THAT THE PROVISIONS OF THIS ORDINANCE BE DEEMED SEVERABLE; PROVIDING FOR THIS ORDINANCE TO BE IN FULL FORCE AND EFFECT FROM AND AFTER PASSAGE, APPROVAL AND PUBLICATION ACCORDING TO LAW. WHEREAS, land described in Section 1 of this Ordinance are adjacent to City limits on two sides; and WHEREAS, the land described in Section 1 of this Ordinance have been requested to be annexed by the owner or representative thereof; and WHEREAS, Idaho Code Section 50-222 authorizes City annexation of tracts of land adjacent to the City; and WHEREAS, the Moscow Mayor and City Council held a public hearing regarding this matter on June 6, 2005; and WHEREAS, the annexation described herein has been deemed consistent with Moscow annexation policy set forth in Resolution 2001-15. NOW THEREFORE, be it ordained by the Mayor and Council of the City of Moscow as follows: SECTION 1: LEGAL DESCRIPTION: This Ordinance shall apply to the following described lands in Moscow, Latah County, Idaho, to-wit: A portion of the south half of Section 16, Township 39 North, Range 5 West, Boise Meridian, Latah County, Idaho described as follows: BEGINNING at the southwest corner of said Section 16; thence along the existing City of Moscow corporate limit line, North 1304.03 feet along the west line of said Section 16 to a point lying 50.00 feet southwesterly measured perpendicularly from the centerline a 200 foot wide abandoned railroad right-of-way commonly known as the Northern Pacific Railway Company Lewiston Branch Line; thence easterly, parallel with and 50.00 feet southerly of said railroad centerline, the following courses: 364.45 feet along a non-tangent curve to the left having a radius of 1959.86 feet, a central angle of !8°32'52" and a chord bearing S84°07'17"E 631.68 feet; thence N86°37'43"E 1716.95 feet; thence easterly 1000.07 feet along a curve to the left having a radius of 3869.72 feet, a central angle of 14°48'26", and a chord bearing N79°13'41"E 997.29 feet, to the east boundary of Lot 45 as shown on the Plat of Section 16 recorded in Book 2 of Plats, page 36, records of Latah County; thence leaving said existing corporate boundary and leaving said parallel line, S00°14'20"E 1111.20 feet along the east boundaries of Lot 45, Lot 52, and Lot 61 of said Plat of 0RDl:\A\;Cl; 2005 17 THOMPSO! PAGE 1 of2 ---PAGE BREAK--- Section 16 to the southeast corner of the North 271.5 feet of said Lot 61; thence along the south boundary of the North 271.5 feet of said Lot 61, S89°22'43"W 664.76 feet to the centerline of a vacated 80 foot wide right-of-way; thence along said centerline, S00°02'4l "W 388.57 feet to the south line of said Section 16; thence along said south line, S89°34'3l "W 2661.74 feet to the POINT OF BEGINNING. Said area contains 93.81 acres, more or less. 498653 SECTION 2: ANNEXATION: The land described in Section 1 of this Ordinance be and the same hereby are, annexed to the City of Moscow, Idaho and declared a part of the City of Moscow, Idaho; and the Moscow City Engineer is hereby ordered to make the necessary amendments to the official City limits map, zoning map, and Area of City Impact map for the City of Moscow, Idaho, which are on file at City Hall. SECTION 3: SEVERABILITY: Provisions of this Ordinance including every exhibit subpart of Section 1 of this Ordinance, shall be deemed severable and the invalidity of any provision of this Ordinance including any exhibit subpart of Section 1 of this Ordinance, shall not affect the validity of remaining provisions or subparts. SECTION 4: EFFECTIVE DATE: This Ordinance shall be effective upon its passage, approval and publication according to law. PASSED by the City Council on the 6111 day of June and APPROVED by the Mayor this 23'd day of August, 2005.
