GENERAL RELEASE AND HOLD HARMLESS AGREEMENT FOR ARTWALK 2015 ON JUNE 12, 205 BETWEEN CITY OF MOSCOW, IDAHO AND CHRIS LAZAR KNOW ALL PERSONS BY THESE PRESENTS: Chris Lazar (hereinafter "Artist"), in consideration of being given the opportunity to publicly demonstrate the creation process of Artist's work and creation of actual works of Art during Artwalk 2015, Moscow, Idaho, on the 12th day of June, 2015, from 5:00 p.m. to 10:00 p.m. (hereinafter "Activity"), does hereby agree to defend and indemnify and does hereby release, hold harmless, acquit and forever discharge City of Moscow, Idaho (hereinafter "City") and its successors, assigns, agents, servants, employees and insurers, and all persons acting for, by or through or in any way in behalf of City, of and from all legal and equitable claims, of every kind, actions, causes of action, judgments, damages, liabilities and demands of whatsoever kind, name, or nature, known or unknown, contingent or mature, in any way having to do with, arising, having arisen, to arise, or which may arise out of or by reason of Activity, which results in or relates to, in any way, property damage or any death or injury suffered or incurred during or as a result of such Activity. Artist specifically acknowledges that this General Release and Hold Harmless Agreement is entered into with the knowledge that creation of Art may contain dangerous or hazardous conditions, including welding and grinding, and this General Release and Hold Harmless Agreement is intended to serve as a waiver of all claims that may arise out of harm, damage, death or injuries suffered during Activity, and that City has informed Artist of such conditions prior to Activity. City and Artist agree that, due to potentially dangerous or hazardous conditions, the general public must remain at least twenty feet (20') from the Art during its creation. Such twenty foot (20') area shall be designated and secured with barricades and caution tape. If at any time, during the public demonstration, the City's Fire Marshal determines the public demonstration has become too dangerous in the Fire Marshal's sole opinion, Artist will cease the public demonstration immediately. Artist agrees the Fire Marshal's decision shall be final and Artist has no right to appeal the Fire Marshal's decision. Artist agrees to remove materials used for this Activity after completion of Activity or anytime immediately after any determination of the Fire Marshal to cease the public determination. Artist agrees to be financially responsible for any damage beyond the general conditions existing at the beginning of Artwalk 2015.
