RESOLUTION 2012- 10 A RESOLUTION OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, AUTHORIZING THE DESIGNATION OF AN APPROXIMATELY 12.7 ACRE PROPERTY LEGALLY DESCRIBED HEREIN AND AS SHOWN ON EXHIBIT A IT ACHED HERETO, AND IN CORPORA TED HEREIN BY THIS REFERENCE, AS AUTO-URBAN RESIDENTIAL (AU-R); PROVIDING THAT THIS RESOLUTION BE IN EFFECT UPON ITS PASSAGE, APPROVAL, AND PUBLICATION ACCORDING TO LAW. WHEREAS, the owner of the subject property has requested annexation of the subject land within the City of Moscow; and WHEREAS, in accordance with Idaho Code, the City must determine the appropriate Comprehensive Plan Land Use Designation for the subject property upon annexation; and WHEREAS, the subject property is cuiTently located within the City of Moscow Area of City Impact and is designated as Auto-Urban Residential (AU-R) upon the City of Moscow Comprehensive Plan; and WHEREAS, the Planning and Zoning Commission after conducting a duly noticed public hearing on April 25t11, 2012 recommended that the Comprehensive Plan Land Use Designation of the subject property remain Auto-Urban Residential (AU-R) upon annexation into the City of Moscow; and WHEREAS, the Moscow City Council conducted a public heating on July 16th, 2012 and passed a motion to approve the continued designation of the subject property as Auto-Urban Residential (AU-R) upon Annexation; and NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Moscow, Idaho as follows: That the Comprehensive Plan Land Use Designation of the approximately 12 acres legally described below remain designated as Auto-Urban Residential (AU-R) upon annexation into the City of Moscow, Idaho. Beginning at the northeast corner of Ridgeview Estates 151 Addition to the City of Moscow; Thence S 89°44'48" E, 658.84 feet along the south line of Southgate 3rd Addition to the City of Moscow and the current City of Moscow corporate boundary; Thence S 00°21 '13" W, 704.97 feet along the centerline of an 80 foot wide vacated street right-of-way to the northerly right-of-way line of State Highway 8; Thence southwesterly along the northerly right-of-way line of said State Highway 8 right­ of-way to the current City of Moscow corporate boundary; Thence N 00°39'56" E, 965.99 feet along said City of Moscow corporate boundary, also being the easterly boundary of said Ridgeview Estates 1st Addition, to the point of beginning.
