EASEMENT AGREEMENT FOR RELOCATED WATERLINE THIS AGREEMENT for the conveyance of an easement, in consideration of the vacation of an existing easement and other valuable consideration which is hereby acknowledged, is entered into this I Z'rh- day of January, 2004, by and between the CITY OF MOSCOW, IDAHO, a municipal corporation of the State of Idaho, 206 East Third Street, Moscow, Idaho 83843, GRANTOR, and SHERMAN W. CLYDE and JANICE A. CLYDE, husband and wife, 2940 Clyde Road, Moscow, Idaho 83843, and TIMOTHY W. CLYDE, and LISA H. CLYDE, husband and wife, 1491 Sand Road, Moscow, Idaho 83843, GRANTEES; WITNESSETH: WHEREAS, GRANTOR is the tee owner of certain real property in Latah County, Idaho, described in Warranty Deed No. 470531, records of Latah County, a copy of which is hereto attached as 'Exhibit upon which an easement for a waterline is situated; and WHEREAS, SHERMAN W. CLYDE and JANICE A. CLYDE are the fee owners of certain real property in Latah County, Idaho described in Warranty Deed No. 416366, records of Latah County, a copy of which is hereto attached as 'EXHIBIT with said parcel being the dominant tenement of an existing appurtenant waterline easement across and upon said City of Moscow, Idaho tract; and WdEREAS, THvfOTHY CL öTIE a..1d LISA I-I. CLYDE are th.e fee owners of certain real property in Latah County, Idaho described in Warranty Deed No. 432558, records of Latah County, a copy of which is hereto attached as 'EXHIBIT with said parcel being the dominant tenement of an existing appurtenant waterline easement across and upon said City of Moscow, Idaho tract; and WHEREAS, the subject waterline has been reinstalled at a location outside of the existing easement described in the aforementioned documents; and WHEREAS, GRANTOR desires to convey a new waterline casement to GRANTEES which will allow for the relocated waterline; and WHEREAS, GRANTEES desire to vacate that portion of the existing waterline easement located upon said City of Moscow, Idaho tract, as it serves no purpose and will be superseded by the new waterline easement established by this document; NOW THEREFORE, GRANTOR hereby grants and conveys unto GRANTEES an appurtenant, permanent waterline easement across, over and upon said City of Moscow, Idaho tract, and being more particularly described as follows: A 15 foot wide easement located within the City of Moscow tract described in Warranty Deed No. 470531 on file with the Recorder's oftice of said Latah EASEMENT AGREEMENT FOR RELOCATED WATERLINE Page 1 of 4 ---PAGE BREAK--- HO County, situated in the northwest quarter of Section 19, Township 39 North, Range 5 West, Boise Meridian, Latah County, Idaho, and extending 7.5 feet each side of the following described centerline: Beginning at the northwest comer of said Section 19; thence South 697.69 feet along the west line of said northwest quarter; thence East 1131.41 feet to the easterly boundary of said City of Moscow tract and the TRUE POINT OF BEGINNING; thence S75°56'53"E 150.38 feet; thence S84°l 3'39"E 135.55 feet; thence N85°55'52"E 380.84 feet; thence N84°57'46"E 319.88 feet; thence N82°20'20"E 340.53 feet; thence N54°17'02"E 106.21 feet; thence Nl2°52'08"E 125.86 feet; thence N89°26'48"E 15.25 feet; N24°37'08"E 61.02 feet; thence Nll 059'21"E 83.65 feet; thence N00°40'35"E 150.74 feet to a point on the northerly boundary of said City of Moscow tract and the terminus of this centerline. Said point bears S00°07'56"E 303.66 feet and N89°52'04"E 74.95 feet from the northeast corner of said northwest quarter of Section 19. Said easement contains 28,049 square feet, more or less. For the purpose of constructing, operating, maintaining, and repairing or replacing a private water service line by GRANTEES, their agents or contractors. GRANTOR, its successors and assigns, reserves the right to improve said easement area as long as such improvement shall not unreasonably intertere with the construction, op..,PTation, maintenance, repair and/or reconstruction of the water service line. GRANTOR agrees that it and its heirs or assigns will not build or place any new encroachment thereon which will unreasonably interfere with the right of GRANTEES. GRANTEES, their agents or transferees, shall have the right to perform any maintenance it may deem necessary or wish to exercise in connection with the aforesaid water service line (including, but not limited thereto, the right to make necessary repairs, alterations, and removals or replacement thereof), providing that said maintenance is performed within a reasonable amount of time. Upon exercising these righ.ts, GR..'\NTE S shall restore the property to its prior condition at GRANTEES' expense and in an expedient manner. GRANTEES are granted the aforementioned rights, together with the rights and privileges of ingress and egress to and from said property for the above stated purposes. It is expressly intended that the rights, burdens and restrictions contained in this Easement shall run with the land and shall forever bind the GRANTOR and GRANTEES, their respective heirs, successors and assigns. GRANTEES hereby agree to vacate and abandon all of that portion of the existing waterline easement described in the hereto attached EXHIBIT and EXHIBIT situated within said City of Moscow, Idaho tract.
