RESOLUTION 2010-14 WHEREAS, pursuant to the provisions of Idaho Code 50-344, the City is authorized to maintain and operate solid waste systems; and WHEREAS, for purposes of solid waste services, Council made written findings in Resolution 2003-07, dated September 26, 2003, that it was necessary for the public health, safety and well being of the citizens of City that City enter into a non-exclusive franchise agreement for solid waste services. WHEREAS, the Council entered into a Solid Waste Franchise Agreement dated September 26, 2003 between City of Moscow, Idaho and Latah Sanitation, Inc.; and WHEREAS, Council, for reasons set out herein, now finds it necessary to amend the Solid Waste Franchise Agreement in accordance with the tenns and conditions of such Franchise awarded to Latah Sanitation, Inc.; WHEREAS, Council finds it to be in the best interest of the citizens of Moscow to modify the amount required for a perfonnance bond in Exhibit General Specifications, of the Solid Waste Franchise Agreement, to increase the bond for the fiscal year 2010 and tor each subsequent year thereafter from an amount of one hundred twenty five thousand dollars ($125,000) to an amount of two hundred thousand dollars ($200,000); and WHEREAS, Council finds that this modification to Exhibit is appropriate and desirable to ensure the continuation of an efficient system for the collection of solid waste within the City of Moscow and to cover the risks inherent therein; and WHEREAS, the City wishes to add a program to the Solid Waste Franchise Agreement which will allow Franchisee to process biosolids from City's Waste Water Treatment Plant at Franchisee's Waste Water Biosolids Composting Facility; and WHEREAS, such biosolids composting shall meet all requirements contained in Exhibit which Council and Franchisee agree shall be added to the Solid Waste Franchise Agreement; and WHEREAS, the process for creating compost from City's dewatered sludge shall follow the Standard Operating Procedures set out at Exhibit and its attachment "Jl and WHEREAS, Council finds it necessary to amend the Solid Waste Franchise Agreement by the addition of Exhibit Specifications for Wastewater Biosolids Composting Facility (WBCF), (and its attachment "Jl Franchise Agreement Exhibit Attachment 1 WBCF Compliance Inspections Standard Operating Procedure) for processing of dewatered sludge at the Waste Water Biosolids Composting Facility; and WHEREAS, as a result of the addition of the com posting facility and its practices (included in Exhibit and its attachment "Jl Exhibit "G " , Schedule of Reimbursement of the Solid RESOLUTION 2010-14 AMENDED EXHIBlT'·A PAGE I OF2 ---PAGE BREAK--- Waste Franchise Agreement, should be amended to reflect the costs and charges related to such changes; and WHEREAS, the Schedule of Reimbursement in amended Exhibit will allow City and Franchisee to continue to produce acceptable compost from the City-generated biosolids pursuant to the tenns of the Solid Waste Franchise Agreement; NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Moscow as follows: 1. Council finds it to be in the best interest of the citizens of Moscow to modify the current Solid Waste Franchise Agreement by the amendments of attachments to this Resolution Exhibits (General Specifications), (Schedule of Reimbursement), and (Specifications For Wastewater Biosolids Composting Facility); and 2. Such attachments are adopted as part of this Resolution, the same as if fully transcribed and copied herein; and 3. Council finds these modifications are appropriate and desirable to ensure the continuation of an efficient system for the collection of solid waste, including the production of acceptable compost from biosolids, and to cover the risks inherent therein.
