AMENDMENT TO DEVELOPMENT AGREEMENT BETWEEN G & G DEVELOPMENT, L.L.C. AND CITY OF MOSCOW, IDAHO 5671-03 FOR THE REPLAT OF PARKVIEW ESTATES ADDITION LOT 1, BLOCK 1 THIS AMENDMENT TO DEVELOPMENT AGREEMENT BETWEEN G & G DEVELOPMENT, LLC AND CITY OF MOSCOW, IDAHO FOR THE REPLAT OF PARK.VIEW ESTATES ADDITION LOT 1, BLOCK 1 (hereinafter "Amendment") is entered into this Zs_"cfay of lA , 2014, by and between G & G Development, L.L.C., 140 East Palouse River Drive, Moscow, Idaho, 83843, being the Developer of real property as described herein (hereinafter "DEVELOPER"), and the City of Moscow, Idaho, a municipal corporation of the State of Idaho, 206 East Third Street, Moscow, Idaho, 83843 (hereinafter "CITY"); W I T N E S S E T H : WHEREAS, DEVELOPER wishes to amend, and CITY agrees to amend, the Development Agreement Between G & G Development, L.L.C. And City Of Moscow, Idaho For The Replat Of Parkview Estates Addition Lot 1, Block 1; and WHEREAS, the parties agree to amend that portion of the prior agreements that require DEVELOPER to complete the traffic engineering study before the issuance of any building permit for Lot 1 , Block 1 of the Replat of Block 1 , Lot 1 of Parkview Estates Addition, to include an exception for the .41 acre parcel, located on the NW comer of said lot, created as per City Council approval of lot line adjustment for said parcel on July 7, 2014; NOW, THEREFORE, DEVELOPER and CITY agree to the following amendments: II. Public Improvements B. shall be amended as follows: II. PUBLIC IMPROVEMENTS: . . . B. At the time DEVELOPER develops Phase II, or any portion thereof of Lot 1, Block 1 of the Replat of Lot 1, Block 1 of Parkview Estates Addition to the City of Moscow, DEVELOPER agrees to install all remaining public improvements required by the Development Agreement dated January 5, 2000, and recorded in the records of Latah County, Idaho under Recording Number 448661. DEVELOPER specifically acknowledges that it is anticipated that a traffic signal at the intersection of U.S. Highway 95 and Rodeo Drive shall be required when Lot 1, Block 1 of the Replat of Block 1 , Lot 1 of Park View Estates Addition to the City of Moscow is developed. DEVELOPER acknowledges and agrees that a separate Development Agreement setting forth the detailed requirements for the traffic signal and all related improvements associated therewith shall be negotiated by and between CITY and the responsible developer of Lot 1, Block 1 of the Rep lat of Block 1, Lot 1 of Park View Estates AMENDMENT TO DEVELOPMENT AGREEMENT PARK VIEW ESTATES; G & G DEVELOPMENT AND CITY PAGE 1 OF3 ---PAGE BREAK--- Addition prior to the issuance of any building permit for Lot 1 , Block 1 of the Replat of Block 1, Lot 1 of Park View Estates Addition, with the exception of that certain .41 acre parcel, located in the NW comer of said lot created per City Council approval of lot line adjustment for said parcel on July 7, 2014, which may be issued a building permit prior to the completion of the traffic engineering study. V. Developer's Covenant E. shall be amended as follows: V. DEVELOPER's COVENANT: . . . E. DEVELOPER agrees that the traffic engineering study required by the Development Agreement dated January 5, 2000, and recorded in the records of Latah County, Idaho under recording number 448661 and hereby required by the development of Phase II or any portion of Lot 1 , Block 1 of the Replat of Block 1, Lot 1 of Park View Estates shall be required of the developer of the newly created Lot 1, Block 1 of the Replat of Block 1 , Lot 1 of Park View Estates Addition or any portion thereof, and that any improvements as determined to be warranted by said study shall be designed, paid for, and installed by such developer of Lot 1, Block 1 of the Rep lat of Block 1 , Lot 1 of Park View Estates Addition. DEVELOPER further agrees that improvements required by the traffic engineering study shall be in accordance with Idaho Transportation Department (ITD) standards and that ITD shall review and approve of such study before the issuance of any building permit for Lot 1, Block 1 of the Replat of Block 1, Lot 1 of Park View Estates Addition, with the exception of that certain .4 1 acre parcel, located in the NW comer of said lot created per City Council approval of lot line adjustment for said parcel on July 7, 2014, which may be issued a building permit prior to the completion of the traffic engineering study.
