KIMBALL ENGINEERING, P.A. December 7, 2001 CHANGE ORDER N0.3 Project: City of Moscow, Idaho, Wastewater Treatment Facilities Phase III 1. Delete stair risers (WCD #19): Delete requirement for risers (ease in cleaning - not needed on most stairs) on all stairs except S-A-09 and S-A-10. Add additional bracing and brackets for AB weir baffle as required for proper operation of overflow weir. Deletion and addition of miscellaneous metals results in a no-cost change. No increase or decrease in project Contract time. No cost increase or decrease . ($0.00) 2 . . U ofi irrigation feed line size change (WCD #26): Change line size for first twenty feet ofU ofi irrigation feed line from 1 0" to 24". This will allow for ease, and significantly less expense if this line is upsized in future. No increase or decrease in project Contract time. Cost increase . $7,298.69 3. Landscaping change (WCD #27): Revise landscaping plan along north side of site. Owner requested changes to preserve as many existing trees as possible within construction constraints. No increase or decrease in project Contract time. Cost decrease . ($3,990.00) 4. Fume Hood exhaust piping (WCD #29): Change exhaust dueling on laboratory fume hood from one 12" outlet to two 10" outlets. Owner supplied fume hood actually has two 10" outlets, while Plans indicate only on 12" outlet. Ducting material is chemical and corrosion resistant PVC. No increase or decrease in project Contract time. Cost increase . $1,398.60 5. 8" Air line between blower building and reaeration tank (WCD#30): Furnish and install 8" DI air line between Blower Building and Reaeration tank, to provide additional reaeration capacity and redundancy, while dissolved oxygen problems with the NPDES permit are resolved. Minor plumbing changes in Control Building (WCD #31 Minor plumbing revisions/additions in Control building include, Owner requested gas line to island (not shown on Plans) and modifications to RO system and dishwasher piping/drains. No increase or decrease in project Contract time. Cost increase . $1,581.28 7. Cabinet credit (WCD #32): Contractor's cabinet supplier has agreed to credit the Owner $3,000 on cabinets in the Operations Building. Contractor acknowledges that there was a mis-communication by the cabinet supplier regarding some aspects of the final cabinets shipped to site with respect to Owner's previous review comments on sample cabinet submittal. Owner agrees to accept hinges that are currently on the cabinets, provided that final adjustments with respect to alignment are made. No increase or decrease in project Contract time. Cost decrease . ($3,000.00) 8. Miscellaneous extra work items (WCD #33): Miscellaneous extra work items include sawcut concrete wall on exisitng secondary clarifier, AB scum sump fillet, UW reroute in tunnel, raise CL2 manhole to match finished grade and line relocations. No increase or decrease in project Contract time. Cost increase . $8,818.20 9. Trickling filter rock credit (WCD #34): Provide credit to Owner to leave existing trickling filter rock in place. Due to time of year (wet and cooler) the demolition work on the trickling filters will be accomplished it would be difficult to complete it as originally outlined (dry before hauling) in Contract Documents. Burying rock in-place will allow biomass on rock to degrade in-situ and become inert prior to construction of AB No.1 in the future. Trickling filter concrete walls and mechanical equipment will be removed. Proposed as a credit by PK Contractors. No increase or decrease in project Contract time. Cost decrease . Natural Gas Line relocation on Utility Tunnel roof (WCD #35): Move gas piping for tunnel roof mounted units from center of tunnel roof to south railing line and go underneath anaerobic basin walkway. This will locate gas line as out of the way as much as possible and minimize trip hazard. No increase or decrease in project Contract time. Cost increase . $2,858.64 11. Request by PK Contractors for additional fourteen (14) of contract time per letter dated November 9, 2001. Approve additional fourteen (14) days of project Contract time requested by PK Contractors. PK Contractors agrees that no additional compensation is required, nor is it requested. Owner· alp'!, Comstock, Mayor 1: ACKNOWLEDGMENT OF CHANGE ORDER LIMITS BY CONTRACTOR The increase or decrease in Contract price and/or Contract time stated in each and every Change Order shall unequivocally comprise the total price and/or price adjustment due or owed the Contractor for the work or changes ordered by the Change Order. By executing the Change Order, the Contractor acknowledges and agrees that the stipulated price and/or time adjustments represent full compensation for all the increases or decreases in cost or the time required to perform the Contract as a whole arising directly or indirectly from the Change Order, including costs and delays associated with the interruption of schedules, extended overheads, delay, and cumulative impacts or ripple effect on all other non-affected work under Contract not changed by the Change Order. Signing of the Change Order constitutes full and mutual accord and satisfaction for the adjustment in Contract price and/or time, subject to the current scope of the entire work as set forth in the Contract Documents. Acceptance of this Change Order constitutes an agreement between Owner and Contractor that the Change Order represents an equitable adjustment to the Contract, and that Contractor will waive all rights to file a claim on the Change Order after it is properly executed.
