Box 8036 Moscow, Idaho 83843 122 East 4th Street Moscow, Idaho RE: Your request ofJanuary 13, 1995- Customer Notification Dear Relene: The Administrative Committee of the City Council met on February 13, 1995 to discuss your memo of January 13, 1995 wherein you request that Exhibit A, General Specifications of Solid Waste Franchise Agreement, Section 8 be amended to delete the requirement that LSI make one annual mailing per year to all producers regarding "complaint procedures, rates, fees, regulations, day(s) for scheduled solid waste collection and changes in the operation of the system". In response to your request, the Administrative Committee did not support a contract amendment to Exhibit A, Section 8. This of course would require the approval of the 1.1osco\v City Council in open meeting. However, the Administrative Committee agreed to allow you to suspend the requirement of one annual mailing per year until further notice. This means that although the City is allowing LSI to suspend the requirement of the annual mailing until further notice, the City retains the right to order LSI to resume this annual mailing as required by the contract. Further, LSI understands that the suspension, while for an indefinite period, is not of a permanent nature, but is only for an interim period to determine whether such mailing benefits the public. Please be advised that I shall review this action in eighteen months and we can determine at that time whether or not the suspension of tbis mailing bas had any effect on the public's information regarding solid waste programs. 95-18 ---PAGE BREAK--- Relenc Johnson Page 2 February 14, 1995 I am requesting that you sign the original of this letter in the space indicated below. By signing this letter you acknowledge that the suspension of the annual mailing is of a temporary duration only and you further agree that at any time the City may require you to resume the annual mailing at no additional cost to the City. Please return to me the signed original of this letter in the enclosed self-addressed. stamped envelope. Upon receipt by me of that original letter you may consider that the annual mailing is suspended until further notice. Please retain a copy of the signed letter for your records.
