RESOLUTION NO. 2008-05 A RESOLUTION OF THE CITY OF MOSCOW, IDAHO, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, PROVIDING FOR AN ADDENDUM TO THE REPORT ON ELIGIBILITY FOR THE GREATER DOWNTOWN MOSCOW AREA (KNOWN AS THE LEGACY CROSSING URBAN RENEWAL AREA) AS AN URBAN RENEWAL AREA AND JUSTIFICATION FOR DESIGNATING THE AREA AS APPROPRIATE FOR AN URBAN RENEWAL PROJECT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, at its meeting of May 24, 2007, the Moscow Urban Renewal Agency Board authorized a study or report to consider an urban renewal project for the Greater Downtown Moscow Urban Renewal area (Legacy Crossing Urban Renewal Area) and to analyze and determine whether the area is eligible for urban renewal planning, and provide the Board with a report and recommendation as soon as reasonably possible; and WHEREAS, the Moscow Urban Renewal Agency obtained an eligibility report (the "Report"), which examines the Greater Downtown Moscow (Legacy Crossing Urban Renewal Area) area for the purpose of determining whether such area is a deteriorating area and deteriorated area as defined by Idaho Code, Section 50-2018(9) and 50- 2903(8)(b and WHEREAS, at its meeting of August 7, 2007, the Moscow Urban Renewal Agency Board adopted Resolution 2007-06 accepting the study and authorizing the Chairman of the Moscow Urban Renewal Ageney to transmit the report to the Moscow City Council recommending adoption and authorization and requesting City Council direction; and WHEREAS, at its meeting of September 17, 2007, the Moscow City Council adopted Resolution 2007-24 accepting the area identified in the Eligibility Report and determining it to be a deteriorated or deteriorating area, or a combination thereof, and designating such area as appropriate for an urban renewal project and directing the Agency to identify and propose the boundaries of the Greater Downtown Moscow Urban Renewal area (Legacy Crossing Urban Renewal Area) and to commence the planning process to create the Greater Downtown Moscow Urban Renewal area (Legacy Crossing Urban Renewal Area) identified in the Eligibility Report, which plan may include a revenue allocation provision as allowed by Act. WHEREAS, the Agency has determined that the area bounded to the north by the Legacy Crossing Urban Renewal Area, to the south by Sweet Avenue and to the west by Railroad Street should be appended to the Legacy Crossing Urban Renewal Area; NOW, THEREFORE, BE IT RESOLVED BY THE MEMBERS OF THE CITY COUNCIL OF MOSCOW, IDAHO, AS FOLLOWS: Section 1. That the City Council adopts the addendum of the area bounded to the north by the Legacy Crossing Urban Renewal Area, to the south by Sweet Avenue and to the west by Railroad Street (as described by Exhibit to this Resolution) to the Legacy Crossing Urban Renewal Area. That the City Council makes the findings that the area described in Exhibit meets one or more of the criteria contemplated by Idaho Code §50- 2018(9) and 50-2903(8)(b), including, but not limited to: a predominance of defective or inadequate street layout and faulty lot layout in relation to size, adequacy, accessibility or usefulness. That the City Council: a. Determines that the area described in Exhibit qualifies as an addendum to the Legacy Crossing Urban Renewal Area project and justification for designating the area described in Exhibit as appropriate, for inclusion in the Legacy Crossing Urban Renewal Area project; b. Determines that the Agency should proceed with the preparation of an urban renewal plan including such area described in Exhibit in the Legacy Crossing Urban Renewal Area, including a determination that the boundaries of the Legacy Crossing Urban Renewal Area should include such area described in Exhibit which plan may include a revenue allocation provision as allowed by law.
