11-04 COOPERATIVE AGUEEMENT (Fiber Optic Communication Network) ITS-0002(021) MOSCOW ITS LATAH COUNTY KEY NO. 8781 PARriES THIS COOPERATIVE AGREEMENT (Fiber 0. ptic, Communicati$ NetwS,>rk, hereinafter called "this Agreement") is made and entered into this _d!l day of _k1/d)w:k , 6lvo5'Z{lB4;" by and between the IDAHO TRANSPORTATION DEPAUTMENT (hereafter called "the STATE"), and the CITY OF MOSCOW, a municipal corporation of the State ofidaho (hereafter called "the CITY"). PURPOSE This Agreement is entered into for the purpose of complying with certain provisions of the Federal-Aid Highway Act in obtaining federal-aid to construct the Project, which project is more particularly described herein below. The STATE and CITY mutually agree that it is in the public interest to construct improvements to the US Highway 95 and State Highway 8 traffic signals within the CITY's corporate limits, which improvements are to be made in accordance with the attached plans entitled Exhibit Federal-Aid Highway Project No. ITS-0002(021) (hereinafter called "the Project"). The CITY, by authority of Title 50, Idaho Code, may adopt and enforce traffic control ordinances within its corporate limits in accordance with the Manual on Uniform Traffic Control Devices for Streets and Highwavs, as adopted by the STATK Warrants and vehicular safety considerations exist to justifY the installation of a tiber optic communication network to interconnect traffic signals throughout the City. Authority for this Agreement is established by Section 40-317 of the Idaho Code. The STATE and CITY agree as follows: SECTION I. That the STATE shall: 1. Not guanmtee that Federal-aid will be available for this project. In the event Federal aid is unavailable, this Agreement is void. 2. Program the construction of the Project
