RESOLUTION NO. 97-10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, CONFIRMING THAT THE CITY OF MOSCOW QUALIFIES TO RECEIVE CERTIFICATION OF FRANCHISING AUTHORITY TO REGULATE BASIC CABLE SERVICE RATES. WHEREAS, City of Moscow has filed written certification with the Federal Communications Commission (FCC) which will enable the City to exercise its basic rate regulation authority under the provision of the Cable Television Consumer Protection Act of 1992 (47 uses §543); and WHEREAS, such certification is deemed in the best interests of the City and its citizens; and WHEREAS, the City wishes to receive authority to regulate basic cable service rates in order to exercise its regulation option should it deem such to be necessary; NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Moscow as follows: I. City of Moscow will adopt and administer rate regulation rules in accord with the FCC Rules and Regulations. 2. City of Moscow has the legal authority to adopt and sufficient personnel to administer such Rules and Regulations. 3. City of Moscow will ensure that all procedures and rate regulation proceedings will provide a reaBonable opportunity for consideration of the views of interested parties.
