Project No: Parcel No: Key No: County: RIGHT -OF-WAY CONTRACT STP-M-7564(004) 31 03546 Latah THIS AGREEMENT, made this day of •:;-lvd e_ , between the CITY OF MOSCOW, by and through the MOSCOW CITY COUNCIL, by its Mayor or the authorized representative, herein called "CITY" and Joseph F. Juscen III, herein called "GRANTOR." NOW THEREFORE1 the parties hereto agree as follows: 1. City shall pay Grantor and the Lien Holder (s)1 if any/ such sums of monies as are set out below. Grantor ps to pay all taxes and assessments due and owing, including those for yearM ; and Grantor shall execute and deliver to City a notarized instrument of onveyance corresponding to the interest acquired. 2. This contract shall not be binding unless and until executed by the Mayor of Moscow or the authorized representative. 3. The parties have herein set out the whole of their agreement, the performance of which constitutes the entire consideration for the grant of said right-of-way and shall relieve the City of all future claims or obligations on that account or on account of the location, grade and construction of the proposed street. 4. Grantor represents that to the best of his knowledge no hazardous materials have been stored or spilled on the subject property during his ownership or during previous ownerships at least insofar as he observed or has been informed. In the alternative, if the grantor has knowledge of storage or spill of hazardous materials on the subject property, that information is set out below. This sale is conditioned upon full disclosure of any such information. 5. Grantor agrees to give the Ci lešal and physical possession of the property herein purchased by the City on Itt I Z o or upon Grantor's receipt of payment1 whichever is later. 6.
