CITY OF MOSCOW, IDAHO ACCEPTANCE OF PUBLIC IMPROVEMENTS FOR PARTIAL REPLAT OF HATLEY ADDITION TO THE CITY OF MOSCOW, IDAHO 550487 WHEREAS, the City of Moscow, Idaho, a municipal corporation of the State of Idaho, has entered into various development agreements with entities representing the interests relative to the Partial Replat of Hatley Addition to the City of Moscow, Idaho; and WHEREAS, those development agreements require certain public improvements to be constructed within such Partial Replat of Hatley Addition; and WHEREAS, the City has determined that all appropriate, required public improvements to the Partial Replat of the Hatley Addition have been constructed to the satisfaction of City of Moscow and in accordance with relevant development agreements related thereto; NOW, WHEREFORE, CITY HEREBY ACCEPTS all public improvements required by the development agreements referred to hereinbelow and releases the various signators to such development agreements filed below from design and/or construction of further public improvements pursuant to such agreements: 1. Development Agreement Partial Replat of Hatley Addition, November 4, 1991, between George B. Hatley and lola Hatley, Berneda Grace Hatley Hamilton and Charles Hamilton, and Veletta Rae Hatley Frink and 0. Eugene Frink, and City of Moscow, Idaho (Latah County recording no. 3871 06), including any responsibility to extend Hatley Way from War Bonnet Drive to the Appaloosa Horse Club property as described within Section VI.B of said Development Agreement. 2. Development Agreement Partial Replat of Hatley Addition, November 4, 1991, between George B. Hatley and lola Hatley, Berneda Grace Hatley Hamilton and Charles Hamilton, and Veletta Rae Hatley Frink and 0. Eugene Frink, and the City of Moscow, Idaho (Latah County recording no. 388909). 3. Addendum to Development Agreement Partial Replat of the Hatley Addition, May 1, 1992, between Wai-Mart Stores Inc., George B. Hatley, lola Hatley, Berneda Grace Hatley Hamilton, Charles Hamilton, Veletta Rae Hatley Frink and 0. Eugene Frink, and City of Moscow, Idaho (Latah County recording no. 388910).
