AGREEMENT THIS AGREEMENT, made and entered into this& { day of Ona,;J , 1995, by and between the City of Moscow, a municipal corporation of thes{ate ofldaho (hereinafter referred to as the "OWNER"), and the Moscow Volunteer Fire Department, Inc., a non-profit corporation of the State of Idaho (hereinafter referred to as the "DEPARTMENT"). WITNESSETH: WHEREAS, the OWNER owns property commonly known as the Phillips Property, located north of the City of Moscow in Latah County, Idaho; and WHEREAS, a house is located on the OWNER'S property which OWNER no longer needs (hereinafter referred to as the "HOUSE"); and WHEREAS, the DEPARTMENT is in need of the HOUSE to use in their DEPARTMENT'S training program; and WHEREAS, the parties feel it is in the mutual interest that the DEPARTMENT use OWNER'S HOUSE for the DEPARTMENT'S training program; NOW, THEREFORE, THE PARTIES HEREBY AGREE AS FOLLOWS: 1. The OWNER hereby agrees that the DEPARTMENT may burn the HOUSE located in Latah County, Idaho, as part of the DEPARTMENT'S training program. 2. The OWNER affirms that they have discontinued or released the fire insurance on the HOUSE and will make no claim for fire loss to the HOUSE. 3. The OWNER that, to their knowledge, there are no explosives or hazardous materials on the premises which would make burning the house hazardous. 4. The DEPARTMENT hereby agrees to burn and destroy the HOUSE as part of its DEPARTMENT'S training program. 5. The DEPARTMENT hereby agrees to hold the OWNER harmless from auy injuries or property damage that might result from the burning of the HOUSE during the training exercise. 6. The consideration for this agreement is the mutual promises contained herein. 95-33 ---PAGE BREAK--- WHEREFORE, the OWNER and the DEPARTMENT, by and through its Fire Chief, have, by their signatures, entered into this agreement on the day and year first set forth above.
