ORDINANCE NO. 1271 AN ORDINANCE AMENDING ORDINANCE NO. 1251 OF THE ORDINANCE OF THE CITY OF • MOSCOW, IDAHO, AS AMENDED BY DEFINING, ESTABLISHING AND DECLARING IN THIS ORDINANCE THE BOUNDARIES AND CORPORATE LIMITS OF THE CITY OF MOSCOW, LATAH COUNTY, IDAHO, IN ACCORDANCE WITH THE PROVISIONS OF THE LAWS OF THE STATE OF IDAHO MADE AND PROVIDING FOR THE ESTABLISHMENT OF THE BOUNDARIES AND THE ANNEXATION OF ADJACENT AND CONTIGUOUS TERRITORY: AND FOR THE REPEALING OF ANY OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH; NAD FOR A SEVERANCȮ AND SAVINGS CLAUSE; AND FOR THE EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF MOSCOW, IDAHO: SECTION 1: The City of Moscow, Latah County, Idaho, shall embrace, include and contain within its corporate limits all the territory embraced, included and encompassed within the lines and boundaries as in this Ordinance bounded and described. SECTION 2: The boundaries and corporate limits of the City of Moscow, Latah County, State of Idaho, are hereby established and ordained to be as follows: Commencing at a point on Street, which is 30. 00 feet west of the southeast corner of the northeast quarter of Section 8, T 39 N, R 5 W, B.M.; running thence North along the west right-of-way line of Mountainview Road a distance of 417.35 feet; thence South 89 degrees 30 minutes East a distance of 525. 00 feet; thence South a distance of 387.35 feet to a point which is the southeast corner of Lot 8 of Schumacher's Addition as shown on the recorded plat thereof, said poin·t also being on the north right-of-way line of Street; thence South 89 degrees 29 minutes East along said north right-of-way a distance of 1050.25 feet; thence South a distance of 60. 00 feet to a point on the south right­ of-way line of Street, said point being the northwest corner of the Moscow School District, McDonald School property as described in Book of Deeds 163, page 324, of the Latah County records; SECTION 5: This Ordinance repeals all ordinances or parts of ordin- ances, in conflict with this Ordinance, insofar as said Ordinances in any way conflict with this Ordinance, are hereby repealed. SECTION 6: If any section, sentence, clause or phrase of this Ordinance is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining section, sentences, clauses or phrases of this Ordinance, or the Ordinance as an entirety, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of such section, sentence, clause or phrase. SECTION 7: This Ordinance shall be in full force and effect from and after the date of its passage, approval and first publication thereof.
