OUTDOOR RANGE USE AGREEMENT City of Moscow, Idaho (hereinafter "City") and City of Pullman (hereinafter "User"), enter into this Agreement on the day of mn'{ , 2000 to provide the terms and conditions for use of the Moscow PoliceDepartment Outdoor Police Range Facility (hereinafter "Range"). WHEREAS, the City has a Range located on Butte Road, Latah County, Idaho for use by members of the City's Police Department and other organizations as approved by the City; and WHEREAS, User is desirous of utilizing the Range; and, WHEREAS, City has approved the user as an acceptable party to use the Range; and WHEREAS, Use tees of fifty (50) dollars per day, for each agency, shall be paid to City bj User for the use of the Range. NOW WHEREFORE, 1. City herein consents and grants permission to User to use the Range at such times and under such terms as provided for by the City Police Department's Rules and Regulations, attached as "Exhibit A" and incorporated herein as though fully set forth 2. The term for this Agreement shall be one ( i J year and may be extended or renegotiated by City and User. This Agreement self renews.on an annual basis without action (except tor payment of annual fees to City by User) unless City or User gives thirty (30) days prior written notice to the other party of this Agreement. 3. Lser agrees, af'ter using the Range, to inspect and clean the Range betore leaving. Cleanup includes remaining casings, debris and other materials utilized in any exercise conducted under the terms of this Agreement. City may assess against the User an additional charge if City is required to clean the Range following its use by User. 4. User agrees to save and hold harmless and indemnify City from any and all claims, actions, causes of action or other liability, whether contingent or liquidated, arising out of its use of said premises, pursuant to the terms of this Agreement The User agrees to assume all liability for any injury, bodily or to personal property, which might occur while the User is in possession and/or using the Range. 5. City will provide thirty (30) days prior written notice to User of City's termination of this Agreement upon User's breach of this Agreement. A Rangemaster appointed by each Agency shall supervise all range operations for the safety of all persons on or near the Range. 2. Possession or consumption of alcoholic beverages at the Range is prohibited 3. No person appearing to be under the influence of alcoholic beverage(s) or impaired from the use of medication(s) shall be permitted on the Range 4. No explosive or chemical agent shall be utilized on the Range without the approval of the Moscow Police Department Administrative Sergeant or des1gnee. 5. No targets of any type shall be placed on or on top of the shooting berms. 6. A red flag, provided, shall be flown/displayed on the flagstaff while the Range is in use. 7 All trash will be carried away from the Range daily. 8 All visitors on the Range shall remain in the parking area unless approved to do otherwise by the Rangemaster 9. Unless previous arrangements have been made and prior approval granted from the Moscow Police Department's Administrative Sergeant or designee, the normal hours of use for the Range shall be within daylight hours, Monday through Friday. I 0. No vehicle shall travel on the Range except in the parking area without the prior approval of the Moscow Police Department Administrative Sergeant or designee. 1 I. Anytime the Range is in use, the following items shall be immediately available and in working order l . A police radio or cell phone for emergency communications. 2. Fire extinguishers and shovels in case of a fire. 12. Chandler, Mavor · Date D' ATTEST: Fina c · ---PAGE BREAK--- MOSCOW POLICE DEPARTMENT RANGE USER GUIDELINES AND RULES GUIDELINES FOR RANGE AND EQUIPMENT USE These guidelines and rules have been established to coordinate the use of the Moscow Police Department Outdoor Range Facility ("Range"). This Range is for the exclusive use of law enforcement personnel and agencies with pre-approved user agreements on file with the Moscow Police Department. I All scheduling of Range use shall be approved through the Moscow Police Department's Administrative Sergeant or designee. 2. Every Firearms who supervises in firearms training must be so designated by their Agency. 3 The assigned Rangemaster of every user group shall be responsible to sign the Range key out and sign it back in each day the Range is used. 4. Every shooter using the Range must be a Commissioned Law Enforcement Otlicer. 5 The Moscow Police Department reserves the right to inspect the Range at any time. 6. All expended casings (aluminum included) shall be picked up and removed by the user groups. 7. [terns/equipment used for tactical courses shall be removed from the Range before departing. 8. Every vehicle used for tactical exercises within the Range shall be operated in such a manner as to prevent damage to the vegetation. Every vehicle not involved in support of training needs shall be parked in the main parking area. 9. All target holders and barricades shall be returned to the Range storage area before departing. I 0. Every user group is responsible to provide its own targets and target back material.
