CONSTRUCTION AGREEMENT THIS AGREEMENT, entered into the _L2_ day of January, 1991, by and between the City of Moscow, the OWNER, and Ray L. Eisinger, dba T. E. C. Construction, the CONTRACTOR; WHEREAS, the OWNER desires to have construction work done on its premises at 122 East Fourth street in Moscow, Idaho; and WHEREAS, CONTRACTOR was the low bidder and was awarded this contract by the City Council; NOW THEREFORE, the OWNER and CONTRACTOR, in consideration of mutual covenants hereinafter set forth, agree as follows: 1. WORK. CONTRACTOR shall complete the work specified under the plans and specifications designated 'Police Department Remodel'. Said plans are attached to and incorporated into this agreement and are designated Appendix A and B. Plans include the construction of a six inch raised floor with 3/4 TNG P.L.W. and floor covering; framing partition walls three feet above floor; a metal frame glass door; framing full height wall and frame in existing window to match existing wall surface; construction of storage cabinet, counter, desk of pre-finished Melamean plywood with adjusting shelves and formica tops on counter and desk top. Floor framing shall include accessibility for future wiring consistent with plans. Electrical work includes extending circuits presently used for radios and emergency power system for radios; changing some lights presently on the emergency system to new locations; extra fixtures to emergency system and adjustments of air ducts. Carpet must be polypopelene 28 ounce commercial grade with continuous loop. 2. CONTRACT TIME. All work shall be completed on or before February 8, 1991. A $100 per day payment shall be made by the CONTRACTOR to the CITY for each day thereafter the work is not completed; said payment shall constitute liquidated damages. 3. PAYMENT. OWNER shall pay the CONTRACTOR the sum of $8,669.00 upon completion of all work required under this agreement. ---PAGE BREAK--- 4S MISCELLANEOUS. No assignment of this contract may be made by either party. A licensed electrical contractor shall perform all pertinent electrical work required. This agreement shall be interpreted under the laws of the State of Idaho; all legal actions relating to this contract shall be brought in the District court of the State of Idaho in and for the County of Latah; should litigation result from this contract the prevailing party shall be awarded his costs and reasonable attorney fees. The building contractor shall secure and pay for all building permits, fees, and inspections as required. The building contractor shall be licensed as a public contractor in the State of Idaho and comply with all laws. The bid shall be in lump sum form and shall include the cost of all labor and materials. The contractor shall be responsible for the finished product, including but not limited to, electri­ cal wiring, carpet laying, window installations, painting, etc. The work must be started on or before Jan­ uary 21, 1991 and must be com- #ic < ·I pleted on or before·':'F±bru8ry á· 1991. If ··the sucessful bidder fails to execute ·the contract, the amount of the bid­ der's security shall be forfeited to the City. . . Payment for said construction will be made with regular accounts payable in the month fµllowing com­ pletion of the construction. All completed work shall be electrically safe, rnechanically secure, true to line, plumb and level and shall present a neat and finished appearance.
