RESOLUTION 2008- 08 A RESOLUTION OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, AUTHORIZING THE DESIGNATION OF AN APPROXIMATELY 0.88 ACRE PROPERTY LEGALLY DESCRIBED HEREIN AND AS SHOWN ON EXHIBIT ATTACHED HERETO, AND INCORPORATED HEREIN BY THIS REFERENCE, AS LOW DENSITY RESIDENTIAL (LR); PROVIDING THAT THIS RESOLUTION BE IN EFFECT UPON ITS PASSAGE, APPROVAL, AND PUBLICATION ACCORDING TO LAW. WHEREAS, the owner of the subject property has requested annexation of the subject land within the City of Moscow; and WHEREAS, in accordance with Idaho Code, the City must determine the appropriate Comprehensive Plan Land Use Designation for the subject property upon annexation; and WHEREAS, the subject property is currently located within the City of Moscow Area of City Impact and is designated as Low Density Residential (LR) upon the City of Moscow Comprehensive Plan; and WHEREAS, the Planning and Zoning Commission after the conduct of a public hearing on September 12, 2007 recommended that the Comprehensive Plan Land Use Designation of the subject property remain Low Density Residential (LR) upon annexation into the City of Moscow; and WHEREAS, the Mayor and City Council held a public hearing on this matter on May 19'h, 2008 and passed a motion to approve the continued designation of the subject property as LR upon Annexation; and NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Moscow, Idaho as follows: That the Comprehensive Plan Land Use Designation of the 0.88 acres legally described below remain designated as Low Density Residential upon annexation into the City of Moscow Idaho. Subject Property: A tract of land consisting of the west one half (1/2) of the north one half (1/2) of Lot E of Schumacher's Addition in Latah County, Idaho, recorded as Instrument No. 37010, situated in the northwest quarter of the northwest quarter of Section 9, Township 39 North, Range 5 West, Boise Meridian, and being more particularly described as follows: Commencing at the northwest corner of said Section 9; thence S89°!5'49"E 30.00 feet along the north line of said Section 9; thence South 30.00 feet to the northwest corner of said Lot E of Schumacher's Resolution 2008..08 Comp Plan Amendment !026 N Mountainview Rd Page I of2 ---PAGE BREAK--- Addition and the TRUE POINT OF BEGINNING; thence S89°15'49"E 300.95 feet along the north boundary of said Lot E; thence N00°44' 11 "E 60.00 feet along the current City of Moscow corporate limit boundary to a point on the north right-of-way line of Mountainview Road; thence S89°15'49"E 13.40 feet along said right-of-way line; thence South 178.92 feet to the southeast corner of said west one half (112) of the north one half (112) of Lot E; thence N89°15'49"W 315.12 feet along the south boundary of said Lot E; thence North 118.92 feet along the west boundary of said Lot E to the TRUE POINT OF BEGINNING. Said tract contains 38,297 square feet, more or less. PASSED by the City Council and APPROVED by the Mayor this 19'h day of May, 2008.
