545162 RECEIVED JUL 0 1 2011 PERMANENT PUBLIC UTILITY EASEMENT City of Moscow L.L.F., Inc., an Idaho Corporation, GRANTOR, owner of real property affected hereby, in consideration of one dollar and other valuable consideration in hand paid, does hereby grant the CITY OF MOSCOW, a municipal corporation of the State of Idaho, 206 East Third Street, Moscow, Idaho 83843, GRANTEE, and its agents and assigns, a non­ exclusive permanent easement and right-of-way in which to construct and maintain public utilities, including the right to enter upon, occupy and use property located in the City of Moscow, Latah County, Idaho, as to wit: EASEMENT PART 1 A permanent easement situated in Lot 25, Block 4 of the Anderson 1st Addition to the City of Moscow as shown on the attached 'Exhibit A' and being more particularly described as follows: Beginning at the southwest corner of Lot 15 of said Block 4; thence N85°56'06"E 305.91 feet along the south boundaries of Lots 15 and 16 of said Block 4; thence leaving said south line, S75°18'32"W 135.78 feet; thence S86°51'52"W 172.49 feet; thence N51°47'16"W 13.15 feet to the south boundary of Lot 8 of said Block 4; thence N88°56'34"E 37.33 feet along said south boundary to the southeast corner of said Lot 8; thence N04°03'25"W 14.90 feet along the east boundary of said Lot 8 to the point of beginning. Said easement contains 6004 square feet, more or less. EASEMENT PART 2 A permanent easement situated in Lot 25, Block 4 of the Anderson 1st Addition to the City of Moscow as shown on the attached 'Exhibit A' and being more particularly described as follows: Commencing at the southwest corner of Lot 15 of said Block 4; thence N85°56'06"E 305.91 feet along the south boundaries of Lots 15 and 16 of said Block 4; thence leaving said south line, N75°18'32"E 24.53 feet to the east boundary of Lot 17 of said Block 4 and the TRUE POINT OF BEGINNING; thence N04 °03'52"W 29.48 feet along said boundary to the southwest corner of Lot 22 of said Block 4; thence N85°56'08"E 24.23 feet along the south boundary of said Lot 22; thence S14°41'28"E 24.50 feet; thence S75°18'32"W 29.25 feet to the TRUE POINT OF BEGINNING. Said easement contains 716 square feet, more or less. GRANTOR, its successors and assigns, reserves the right to improve said easement area as long as such improvement shall not unreasonably interfere with the construction, operation, maintenance, repair and/or reconstruction of the public utilities. GRANTOR agrees that it and its successors and assigns will not build or place any new encroachment thereon which will unreasonably interfere with the right of the GRANTEE. The GRANTEE, its agents or transferees, shall have the right to perform any maintenance it may deem necessary or wish to exercise in connection with the aforesaid utilities. Upon exercising these rights, GRANTEE shall restore the property to its prior condition. GRANTEE is granted the aforementioned rights, together with the rights and privileges of ingress and egress to and from said property for the above stated purposes.
